IMPORTANTE - LEGGERE CON ATTENZIONE: IL PRESENTE CONTRATTO DI LICENZA ("CONTRATTO") È UN CONTRATTO LEGALE INTERCORRENTE TRA L UTENTE, UNA PERSONA FISICA O GIURIDICA ("BENEFICIARIO"), E LA ACER INC. ("ACER") PER IL SOFTWARE ACER CHE ACCOMPAGNA QUESTO CONTRATTO, INCLUSO QUALSIASI SUPPORTO AD ESSO ASSOCIATO, MATERIALE STAMPATO E RELATIVA DOCUMENTAZIONE ELETTRONICA (il "SOFTWARE").  INSTALLANDO IL SOFTWARE ALLEGATO, IL BENEFICIARIO ACCETTA DI ESSERE VINCOLATO DAI TERMINI E DALLE CONDIZIONI DI QUESTO CONTRATTO.  SE IL BENEFICIARIO NON ACCETTA TUTTI I TERMINI E TUTTE LE CONDIZIONI DI QUESTO CONTRATTO, NON CONTINUARE CON LA PROCEDURA D INSTALLAZIONE, ELIMINARE IMMEDIATAMENTE, SE È IL CASO, TUTTI I FILE INSTALLATI DEL SOFTWARE ALLEGATO DAL SISTEMA PC DEL BENEFICIARIO.



SE IL BENEFICIARIO NON POSSIEDE UN VALIDO CERTIFICATO DI AUTENTICITÀ DEL SOFTWARE APPLICABILE, IL BENEFICIARIO NON È AUTORIZZATO AD INSTALLARE, COPIARE O ALTRIMENTI USARE IL SOFTWARE E NON HA DIRITTI AI SENSI DI QUESTO CONTRATTO.



GARANZIA DI LICENZA

ACER garantisce al Beneficiario i seguenti diritti non esclusivi e non trasferibili rispetto al Software.  Il Software è protetto dalle leggi e dalle convenzioni sui diritti d'autore Americane ed Internazionali, e da altre leggi e trattati sulla proprietà intellettuale.  ACER possiede il titolo, i diritti d autore e altri diritti di proprietà intellettuale del Software.  ACER si riserva tutti i diritti non espressamente garantiti al beneficiario in questo Contratto.  Il Software è concesso in licenza, non è venduto.  Questo Contratto è un accordo tra il Beneficiario ed ACER relativo solamente al Software concesso in licenza da questo Contratto e tutti gli accordi relativi a qualsiasi altro prodotto o soggetto non sono né intesi né possono essere implicati.  In conformità a questo contratto il Beneficiario può:

1.Installare ed utilizzare il Software solamente su di un singolo computer designato.  È necessaria una licenza distinta per ciascun computer su cui sarà utilizzato il Software.

2.Eseguire una copia del Software esclusivamente a scopo di Backup o archiviazione.

3.Eseguire una copia stampata di qualsiasi documento elettronico incluso nel Software, a condizione che il Beneficiario riceva i documenti elettronicamente.



RESTRIZIONI:

Il Beneficiario NON può:

1.Utilizzare o copiare il Software fatta eccezione per quanto previsto in questo Contratto.

2.Concedere in locazione o in leasing il Software ad alcuna terza parte.

3.Modificare, adattare o tradurre il Software completamente o in parte.

4.Decompilare, decifrare o smontare il Software oppure creare derivati basati sul Software.

5.Combinare il Software con qualsiasi altro programma o modificare il Software, fatta eccezione per l'uso esclusivo del Beneficiario.

6.Concedere in licenza (sottolicenziare) o rendere in altro modo disponibile il Software a terze parti fatta eccezione per la cessione integrale del Software (e non di sue porzioni), previa notifica scritta ad ACER, da parte del Beneficiario a terze parti a condizione che il Beneficiario non trattenga alcuna copia del Software e che la terza parte accetti i termini di questo Contratto.

7.Trasferire a terze parti i diritti del Beneficiario previsti da questo Contratto.

8.Esportare il Software contravvenendo alle leggi ed ai regolamenti applicabili in materia d esportazione.



SERVIZI DI SUPPORTO

ACER non è obbligata a fornire il supporto tecnico o qualsiasi altro tipo di supporto per il Software.



PROPRIETÀ E DIRITTI D AUTORE

Il titolo, i diritti di proprietà ed i diritti di proprietà intellettuale del e sul Software e di tutte le copie da esso derivare restano di proprietà di ACER.  Il Beneficiario non ha e non può acquisire alcun interesse di proprietà del Software (inclusa qualsiasi modifica o copia eseguita dal o per il Beneficiario) o qualsiasi altro relativo diritto di prosperità intellettuale. Il titolo ed i relativi diritti dei contenuti cui si accede tramite il Software, sono di proprietà del titolare del contenuto relativo e possono essere protetti dalle leggi applicabili. Questa licenza non dà al beneficiario alcun diritto su tali contenuti.  Il beneficiario si impegna a

1.Non rimuovere dal Software alcun avviso sui diritti d autore o di proprietà

2.Riprodurre tutti tali avvisi su qualsiasi copia autorizzata eseguita dal Beneficiario

3.Prevenire, al massimo delle sue possibilità, la copiatura non autorizzata del Software



MARCHI REGISTRATI

Questo Contratto non garantisce al Beneficiario alcun diritto riguardo a qualsiasi marchio registrato o marchio di servizio ACER.



CLAUSOLA DI GARANZIA

NELLA MISURA MASSIMA CONSENTITA DALLA LEGGE IN VIGORE, ACER FORNISCE IL SOFTWARE  COME È  CON TUTTI I SUOI DIFETTI, E NEGA TUTTE LE ALTRE GARANZIE E CONDIZIONI, SIANO ESPRESSE, IMPLICITE O LEGALI COMPRESE, TRA LE ALTRE, LE GARANZIE, I DOVERI O LE CONDIZIONI (SE ESISTENTI) IMPLICITE DI COMMERCIABILITÀ, DI IDONEITÀ PER UN FINE PARTICOLARE, DI ACCURATEZZA E COMPLETEZZA DI RISPOSTA, DI RISULTATI, DI SFORZO LAVORATIVO, DI MANCANZA DI VIRUS E MANCANZA DI NEGLIGENZA, IL TUTTO NEI CONFRONTI DEL SOFTWARE E DELLA FORNITURA O LA MANCANZA DI FORNIRE SERVIZI DI SUPPORTO.  INOLTRE, NON C È ALCUNA GARANZIA O CONDIZIONE DI TITOLO, DI DIVERTIMENTO SOTTINTESO, DI POSSESSO SOTTINTESO, CORRISPONDENZA ALLA DESCRIZIONE O DI NON  INCOMPATIBILITÀ NEI RIGUARDI DEL SOFTWARE.



ESCLUSZIONE DEI DANNI ACCIDENTALI, CONSEGUENTI E DI CERTI ALTRI DANNI

NELLA MISURA MASSIMA CONSENTITA DALLA LEGGE IN VIGORE, ACER NON PUÒ ESSERE RITENUTA RESPONSABILE PER QUALSIASI DANNO SPECIALE, ACCIDENTALE, INDIRETTO, PUNITIVO O QUALSIASI ALTRO TIPO DI DANNO (INCLUSI, TRA GLI ALTRI, I DANNI RELATIVI A: PERDITA DI PROFITTO; INFORMAZIONI CONFIDENZIALI O ALTRE INFORMAZIONI; INTERRUZIONE DI ATTIVITÀ; LESIONI PERSONALI; PERDITA DI PRIVACY; IMPOSSIBILITÀ DI SODDISFARE QUALSIASI DOVERE INCLUSA LA BUONA FEDE E LA NORMALE DILIGENZA; NEGLIGENZA; E QUALSIASI ALTRA PERDITA PECUNIARIA O ALTRE PERDITE) PROVOCATO DA, O IN QUALSIASI RELAZIONE CON L USO DEL SOFTWARE, LA FORNITURA O LA MANCANZA DI FORNIRE SERVIZI DI SUPPORTO, O DIVERSAMENTE CONTEMPLATO O IN RELAZIONE CON QUALSIASI DISPOSIZIONE DI QUESTO CONTRATTO, ANCHE IN CASO DI MANCANZA, TORTO (INCLUSA LA NEGLIGENZA), RESPONSABILITÀ DIRETTA, VIOLAZIONE DEL CONTRATTO O VIOLAZIONE DELLA GARANZIA ACER, ED ANCHE SE ACER È STATA AVVISATA DELLA POSSIBILITÀ DI TALI DANNI.



LIMITAZIONE DELLA RESPONSABILITÀ E RIMEDI

IN DEROGA A QUALSIASI DANNO CHE IL BENEFICIARIO PUÒ SUBIRE PER QUALSIASI MOTIVO (INCLUSI, TRA GLI ALTRI, TUTTI I DANNI SOPRA DESCRITTI E TUTTI I DANNI DIRETTI O GENERALI), L INTERA RESPONSABILITÀ DI ACER PREVISTA AI SENSI DI QUALSIASI DISPOSIZIONE DI QUESTO CONTRATTO, ED IL RIMEDIO ESCLUSIVO DEL BENEFICIARIO PER TUTTI I DANNI DETTI IN PRECEDENZA, È LIMITATA ALLA SOMMA COMPLESSIVA PAGATA DAL BENEFICIARIO PER IL SOFTWARE.  LE LIMITAZIONI, LE ESCLUSIONI E LE CLAUSOLE DETTE IN PRECEDENZA, (INCLUSA LA CLAUSOLA DI GARANZIA E L ESCLUSZIONE DEI DANNI ACCIDENTALI, CONSEGUENTI E DI CERTI ALTRI DANNI DI CUI SOPRA) DEVONO ESSERE APPLICATE NELLA MISURA MASSIMA CONSENTITA DALLA LEGGE IN VIGORE, ANCHE SE IL RIMEDIO NON SODDISFA IL SUO SCOPO ESSENZIALE.



TERMINAZIONE

Senza pregiudicare qualsiasi altro diritto, Acer può terminare immediatamente senza preavviso questo Contratto se il Beneficiario non si adegua a qualsiasi termine e condizione di questo Contratto.

In questo caso il beneficiario deve:

1.Sospendere l uso del Software;

2.Distruggere o restituire ad ACER l originale e tutte le copie del Software;

3.Eliminare il Software da tutti i computer su cui è stato installato.

Tutte le clausole delle garanzie e le limitazioni di responsabilità dichiarate in questo Contratto, continueranno anche dopo la terminazione di questo Contratto.



GENERALE

Questo Contratto è governato ed interpretato in accordo alle Leggi di Taiwan, Repubblica Cinese, fatta eccezione per quegli organismi legislativi che trattano i conflitti di legge.  Questo Contratto rappresenta l accordo completo tra le parti riguardo alla licenza di questo Software e  sostituisce tutti gli accordi, comunicazioni, proposte e dichiarazioni precedenti tra le parti, e prevale su qualsiasi termine conflittuale o aggiuntivo di qualsiasi quotazione, ordine, riconoscimento o comunicazione simile.  Questo Contratto può essere modificato solamente da un documento scritto firmato da entrambe le parti. Nel caso in cui un tribunale di giurisdizione competente trova contraria alla legge una qualsiasi disposizione di questo Contratto, quella disposizione sarà fatta valere nella misura massima consentita dalla legge, e le disposizioni rimanenti di questo Contratto resteranno pienamente attive ed affettive.





Nota: a causa di possibili errori di traduzione, tutte le polizze ed i termini contenuti in qualsiasi documento diverso da quello in lingua Inglese, devono fare riferimento alle polizze ed ai termini specificati nel documento in lingua Inglese.



Acer End User License Agreement



IMPORTANT-READ CAREFULLY: THIS ACER END USER LICENSE AGREEMENT ("AGREEMENT") IS A LEGAL AGREEMENT BETWEEN YOU, EITHER AN INDIVIDUAL OR ENTITY ("LICENSEE"), AND ACER INC. ("ACER") FOR THE ACER SOFTWARE THAT ACCOMPANIES THIS AGREEMENT, INCLUDING ANY ASSOCIATED MEDIA, PRINTED MATERIALS AND RELATED USER ELECTRONIC DOCUMENTATION (the "SOFTWARE").  BY INSTALLING THE ACCOMPANYING SOFTWARE, LICENSEE AGREES TO BE BOUND BY THE TERMS AND CONDITIONS OF THIS AGREEMENT.  IF LICENSEE DOES NOT AGREE TO ALL OF THE TERMS AND CONDITIONS OF THIS AGREEMENT, DO NOT CONTINUE THE INSTALLATION PROCESS, IMMEDIATELY DELETE ALL INSTALLED FILES, IF ANY, OF THE ACCOMPANYING SOFTWARE FROM LICENSEE'S COMPUTER SYSTEM.



IF LICENSEE DOES NOT HAVE A VALIDLY-LICENSED COPY OF THE APPLICABLE SOFTWARE, LICENSEE IS NOT AUTHORIZED TO INSTALL, COPY OR OTHERWISE USE THE SOFTWARE AND HAS NO RIGHTS UNDER THIS AGREEMENT.



GRANT OF LICENSE

ACER grants Licensee the following non-exclusive and non-transferable rights with respect to the Software.  The Software is protected by U.S.A and international copyright laws and conventions as well as other intellectual property laws and treaties.  ACER owns the title, copyright, and other intellectual property rights in the Software.  ACER reserves all rights not expressly granted to Licensee in this Agreement.  The Software is licensed, not sold.  This Agreement is an agreement between Licensee and ACER solely with respect to the Software licensed by this Agreement and agreements relating to any other product or topic are neither intended nor should be implied.  According to this Agreement, the Licensee may:

1.Install and use the Software only on a single designated computer.  A separate license is required for each computer on which the Software will be used;

2.Make one copy of the Software solely for backup or archival purposes;

3.Make one hardcopy of any electronic documents included in the Software, provided that Licensee receives the documents electronically.



RESTRICTIONS:

Licensee may NOT:

1.Use or copy the Software except as provided in this Agreement;

2.Rent or lease the Software to any third party;

3.Modify, adapt, or translate the Software in whole or in part;

4.Reverse engineer, decompile, or disassemble the Software or create derivative works based upon the Software;

5.Merge the Software with any other program or modify the Software except solely for Licensee's personal use; and

6.Sublicense or otherwise make the Software available to third parties except that Licensee may, after prior written notification to ACER, transfer all (but no lesser portion) of the Software to a third party so long as Licensee does not retain any copies of the Software and such third party accepts the terms of this Agreement.

7.Transfer Licensee's rights under this Agreement to any third parties.

8.Export the Software in contravention of applicable export laws and regulations.



SUPPORT SERVICES

ACER is not obligated to provide technical or other support for the Software.



OWNERSHIP & COPYRIGHT

Title, ownership rights and intellectual property rights in and to the Software and all copies thereof shall remain in ACER.  Licensee does not have or shall not gain any proprietary interest in the Software (including any modifications or copies made by or for Licensee) or any related intellectual property rights. Title and related rights in the content accessed through the Software is the property of the applicable content owner and may be protected by applicable law. This license gives Licensee no rights to such contents.  Licensee hereby agrees

1.Not to remove any copyright or other proprietary notices from the Software;

2.To reproduce all such notices on any authorized copies Licensee makes; and

3.To use best efforts to prevent any unauthorized copying of the Software.



TRADEMARKS

This Agreement does not grant Licensee any rights in connection with any trademarks or service marks of ACER.



DISCLAIMER OF WARRANTIES

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ACER PROVIDES THE SOFTWARE "AS IS" AND WITH ALL FAULTS, AND HEREBY DISCLAIMS ALL OTHER WARRANTIES AND CONDITIONS, EITHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING, BUT NOT LIMITED TO, ANY (IF ANY) IMPLIED WARRANTIES, DUTIES OR CONDITIONS OF MERCHANTABILITY, OF FITNESS FOR A PARTICULAR PURPOSE, OF ACCURACY OR COMPLETENESS OF RESPONSES, OF RESULTS, OF WORKMANLIKE EFFORT, OF LACK OF VIRUSES, AND OF LACK OF NEGLIGENCE, ALL WITH REGARD TO THE SOFTWARE AND THE PROVISION OF OR FAILURE TO PROVIDE SUPPORT SERVICES.  ALSO, THERE IS NO WARRANTY OR CONDITION OF TITLE, QUIET ENJOYMENT, QUIET POSSESSION, CORRESPONDENCE TO DESCRAcer End User License Agreement

IF LICENSEE DOES NOT HAVE A VALIDLY-LICENSED COPY OF THE APPLICABLE SOFTWARE, LICENSEE IS NOT AUTHORIZED TO INSTALL, COPY OR OTHERWISE USE THE SOFTWARE AND HAS NO RIGHTS UNDER THIS AGREEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ACER PROVIDES THE SOFTWARE "AS IS" AND WITH ALL FAULTS, AND HEREBY DISCLAIMS ALL OTHER WARRANTIES AND CONDITIONS, EITHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING, BUT NOT LIMITED TO, ANY (IF ANY) IMPLIED WARRANTIES, DUTIES OR CONDITIONS OF MERCHANTABILITY, OF FITNESS FOR A PARTICULAR PURPOSE, OF ACCURACY OR COMPLETENESS OF RESPONSES, OF RESULTS, OF WORKMANLIKE EFFORT, OF LACK OF VIRUSES, AND OF LACK OF NEGLIGENCE, ALL WITH REGARD TO THE SOFTWARE AND THE PROVISION OF OR FAILURE TO PROVIDE SUPPORT SERVICES.  ALSO, THERE IS NO WARRANTY OR CONDITION OF TITLE, QUIET ENJOYMENT, QUIET POSSESSION, CORRESPONDENCE TO DESCRIPTION OR NON-INFRINGEMENT WITH REGARD TO THE SOFTWARE.



EXCLUSION OF INCIDENTAL, CONSEQUENTIAL AND CERTAIN OTHER DAMAGES

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ACER BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS OR CONFIDENTIAL OR OTHER INFORMATION, FOR BUSINESS INTERRUPTION, FOR PERSONAL INJURY, FOR LOSS OF PRIVACY, FOR FAILURE TO MEET ANY DUTY INCLUDING OF GOOD FAITH OR OF REASONABLE CARE, FOR NEGLIGENCE, AND FOR ANY OTHER PECUNIARY OR OTHER LOSS WHATSOEVER) ARISING OUT OF OR IN ANY WAY RELATED TO THE USE OF OR INABILITY TO USE THE SOFTWARE, THE PROVISION OF OR FAILURE TO PROVIDE SUPPORT SERVICES, OR OTHERWISE UNDER OR IN CONNECTION WITH ANY PROVISION OF THIS AGREEMENT, EVEN IN THE EVENT OF THE FAULT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, BREACH OF CONTRACT OR BREACH OF WARRANTY OF ACER, AND EVEN IF ACER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.



LIMITATION OF LIABILITY AND REMEDIES

NOTWITHSTANDING ANY DAMAGES THAT LICENSEE MIGHT INCUR FOR ANY REASON WHATSOEVER (INCLUDING, WITHOUT LIMITATION, ALL DAMAGES REFERENCED ABOVE AND ALL DIRECT OR GENERAL DAMAGES), THE ENTIRE LIABILITY OF ACER UNDER ANY PROVISION OF THIS AGREEMENT AND LICENSEE EXCLUSIVE REMEDY FOR ALL OF THE FOREGOING SHALL BE LIMITED TO THE AGGREGATE AMOUNT PAID BY LICENSEE FOR THE SOFTWARE.  THE FOREGOING LIMITATIONS, EXCLUSIONS AND DISCLAIMERS (INCLUDING DISCLAIMER OF WARRANTIES AND EXCLUSION OF INCIDENTAL, CONSEQUENTIAL AND CERTAIN OTHER DAMAGES ABOVE) SHALL APPLY TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EVEN IF ANY REMEDY FAILS ITS ESSENTIAL PURPOSE.



TERMINATION

Without prejudice to any other rights, Acer may immediately terminate this Agreement without notice if Licensee fails to comply with any terms and conditions of this Agreement.

In such event, Licensee must:

1. Cease all use of the Software;

2. Destroy or return to ACER the original and all copies of the Software; and

3. Delete the Software from all computers on which it was resident.

All disclaimers of warranties and limitation of liability set forth in this Agreement shall survive termination of this Agreement.



GENERAL

This Agreement is governed by and interpreted in accordance with the laws of Republic of China, Taiwan except for that body of law dealing with conflicts of law.  This Agreement represents the complete agreement between the parties relating to this license for the Software and supersedes all prior agreements, communications, proposals and representations between the parties and prevails over any conflicting or additional terms of any quote, order, acknowledgement or similar communication.  This Agreement may only be modified by a written document signed by both parties. If any provision of this Agreement is held by a court of competent jurisdiction to be contrary to law, that provision will be enforced to the maximum extent permissible and the remaining provisions of this Agreement will remain in full force and effect.

How To Update Drivers Manually

After your driver has been downloaded, follow these simple steps to install it.

  • Expand the archive file (if the download file is in zip or rar format).

  • If the expanded file has an .exe extension, double click it and follow the installation instructions.

  • Otherwise, open Device Manager by right-clicking the Start menu and selecting Device Manager.

  • Find the device and model you want to update in the device list.

  • Double-click on it to open the Properties dialog box.

  • From the Properties dialog box, select the Driver tab.

  • Click the Update Driver button, then follow the instructions.

Very important: You must reboot your system to ensure that any driver updates have taken effect.
