TechniSat DVB-PC TV Star License Agreement

This is a legal agreement between you (either individual or an entity), the end user and TechniSat Digital GmbH ("TechniSat"), concerning the enclosed software ("Software") and the DVB-PC TV Star device ("Card").

1. GRANT OF LICENSE.
This Agreement permits you to use the Card on a single computer and to use one copy of the Software on that computer.

2. COPYRIGHT.
The Software and its component parts are owned by TechniSat or its suppliers and are protected by copyright laws and international treaty provisions. Therefore, you must treat Software and associated documentation like any other copyrighted material except that you may either (a) make one additional copy of the Software solely for backup or archival purposes or (b) transfer the Software to the hard disk of the computer provided you keep the original solely for backup or archival purposes. You may not copy the written materials accompanying the Software.

3. OTHER RESTRICTIONS.
You may not rent or lease the Software or Card, but you may transfer your rights under this Agreement on a permanent basis provided you transfer the Software, Card and all accompanying written materials, retain no copies of the Software and the recipient agrees to the terms of this Agreement. You may not reverse engineer, decompile, or disassemble the Software.

LIMITED WARRANTY.
TechniSat warrants that (a) the Software will perform substantially in accordance with accompanying written materials for a period of 90 days from the date of receipt; and (b) the Card will be free from defects in material workmanship under normal use and service for a period of ONE (1) year from the date of receipt. Any implied warranty is limited to ninety (90) days and ONE (1) year respectively. Some states/jurisdictions do not allow limitations on duration of an implied warranty, so the above limitations do not apply to you.

CUSTOMER REMEDIES.
At TechniSat's option, TechniSat will either repair or replace the Software or Card that do not meet TechniSat's Limited Warranty. This limited warranty is void if failure of the Software or Card has resulted form accident, abuse, or misapplication. Any replacement Software and Card would be warranted for the remainder of the original warranty period or thirty (30) days, whichever is longer.

NO OTHER WARRANTIES.
To the maximum extent permitted by applicable law, TechniSat disclaims all other warranties, either express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose, with respect to the Software, the Card, and accompanying written materials. This limited warranty gives you specific rights. You may have others, which may vary form state/jurisdiction to state/jurisdiction.

NO LIABILITY FOR CONSEQUENTIAL DAMAGES.
To the maximum extent permitted by law, in no event shall TechniSat or its suppliers be liable for any damages whatsoever (including, without limitation, damages for loss of business, interruption, loss of business information, or other pecuniary loss) arising out of the use of or inability to use the Software, Card, or accompanying written materials, even if TechniSat has been advised of the possibility of such damages.
