Software Licence Agreement 

Preamble

If you agree with the following terms of the contract, click the Accept button. The software installation will then continue.
Your agreement is used for a legally binding contract between you as final user of the software ("user" in the following) and TechnoTrend AG ("TechnoTrend" in the following). 

If you have agreed to this contract, TechnoTrend grants you the non-exclusive and individual right ("licence" in the following) to use the accompanying software ("software" in the following). 

In the following, TechnoTrend hardware includes products developed and marketed by TechnoTrend as well as products developed by TechnoTrend and marketed by TechnoTrend/OEM partners.


1. Rights of ownership
The software represents copyright protected material of TechnoTrend. Through this contract you are not made owner of the software, but rather are granted permission to use the software according to the provisions of this contract. Broader rights are not acquired.

2. Scope of use
Through this licence, TechnoTrend grants you the right to use the software in connection with TechnoTrend hardware. By use is meant any long-term or temporary application of the software through saving, loading, running or displaying for the purpose of executing the program, as well as the processing of data contained in the software. Application of the software using other (not TechnoTrend) hardware is prohibited.

3. Rights of reproduction

3.1. The user may only reproduce the software if its usage so requires. This includes the installation as well as loading into the working memory. 

3.2. The user is authorised to create and store a backup copy providing this is necessary to ensure future use. This backup copy of the software is to be identified as such. 

3.3. The user may not make additional copies of the software. The documentation may not be reproduced.

3.4. Reverse engineering, decompiling or disassembling of the software is prohibited.

Company names, serial numbers and other attributes in the program serving software identification, as well as other notes regarding legal reservations, may not be changed.

4. Disclosure

4.1. The user is not authorised to confer sublicences or to share, rent, lease, or otherwise transfer the rights conceded to him/her through this contract, unless permission to do so is explicitly stated within the contract. 

4.2. Any reproduction or further distribution of the software beyond the terms stipulated within this licensing agreement is explicitly prohibited and is subject to prosecution in civil and criminal courts.

5. Warranty and exclusion from liability 

This software was carefully crafted and tested by TechnoTrend and is made available to the user at no cost. Please note that it is not possible to develop software programs that can be used faultlessly under all application conditions. TechnoTrend does not guarantee that the software is suitable for a particular application or configuration. TechnoTrend assumes no liability for errors in the software or damage resulting from either its use or its unsuitability for use. This includes the loss of business profit, the interruption of business processes, the loss of data, as well as all other material and immaterial losses and thereby resulting damage.

The total maximum liability is limited to the registration fee, should you have paid one for the software.

6. Final clause

If individual provisions in these terms are or become null and void, invalid or contestable, the validity of all other provisions or agreements is not affected.
