HOWTEK, INC. SOFTWARE LICENSE AGREEMENT IMPORTANT! READ THIS BEFORE PROCEEDING TO USE THE 4500 FLASH DOWNLOAD SOFTWARE (THE "SOFTWARE"). USE OF THE SOFTWARE SIGNIFIES YOUR ACCEPTANCE OF THE TERMS AND CONDITIONS OF THIS LICENSE AGREEMENT. IF YOU DO NOT ACCEPT THIS AGREEMENT, RETURN THE SOFTWARE TO HOWTEK. 1. LICENSE GRANT AND RESTRICTIONS. You are granted a nonexclusive and non- transferable license to use the Software and accompanying documentation. The Software may only be used in conjunction with the 4500 or another Howtek product. You may not alter the Software. You may not distribute or sub-license the Software on either a permanent or a temporary basis to others. Title to the Software is not transferred to you. You further agree not to translate, disassemble, decompile or reverse engineer the Software, in whole or in part. 2. RESTRICTIONS UPON TRANSFER OF SOFTWARE. You may not transfer the Software unless (i) this Software License Agreement is transferred with the Software, and (ii) the transferee fully accepts the terms and conditions of this Agreement. 3. CUSTOMER COMMUNICATION OF RESTRICTIONS. You agree to communicate the re- stricted conditions of this Agreement to those persons employed by you or under your direction and control that come in contact with the Software. 4. CUSTOMER COMPLIANCE AND UNAUTHORIZED USE. You agree to use all reasonable efforts to ensure that persons employed by you or under your direction and control abide by the terms and conditions of the Software License Agreement including, without limitation, not knowingly permitting anyone to use any portion of the Software for the purpose of deriving its source code. In the event you become aware that the Software is being used by any persons in a manner not authorized by this Agreement, you shall immediately use all reasonable efforts to have such unauthorized use of such Software immediately cease. You shall notify Howtek in writing of the unauthorized use in the event that such unauthorized use continues after you become aware thereof. 5. ENTIRE AGREEMENT. This Software License Agreement is the entire agreement between Howtek and you pertaining to the Software and supersedes all pro- posals or prior and contemporaneous agreements or understandings of the parties regarding the Software. YOU AGREE THAT ANY TERMS AND CONDITIONS CONTAINED IN ANY PURCHASE ORDER OR OTHER ORDERING DOCUMENTS SUBMITTED PURSUANT HERETO SHALL HAVE NO BINDING EFFECT ON HOWTEK AND WILL NOT MODIFY THIS SOFTWARE LICENSE AGREEMENT IN ANY WAY. 6. GOVERNING LAW. This agreement will be governed, construed and interpreted by, and in accordance with, the laws of the State of New Hampshire. 7. NO WARRANTIES OF PERFORMANCE. THE SOFTWARE IS PROVIDED "AS-IS" AND ALL WARRANTIES AND REPRESENTATIONS OF ANY KIND WITH REGARD TO THE SOFTWARE ARE HEREBY DISCLAIMED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. UNDER NO CIRCUMSTANCES WILL HOWTEK, THE MANUFACTURER, DEVELOPER, OR OWNER OF THE SOFTWARE BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, SPECIAL OR EXEMPLARY DAMAGES EVEN IF APPRISED OF THE LIKELIHOOD OF SUCH DAMAGES OCCURRING. YOUR SOLE REMEDY HEREUNDER IS TO RETURN THE LICENSED SOFTWARE AND DOCUMENTATION TO HOWTEK FOR REPAIR OR REPLACEMENT, WITHIN NINETY DAYS OF PURCHASE. 8. NOTICE TO GOVERNMENT END USERS. If the Software is acquired under the terms of (i) GSA contract; Use, reproduction or disclosure is subject to the restrictions set forth in the applicable ADP Schedule contract; (ii) DoD contract; Use, duplication or disclosure by the Government is subject to restrictions as set forth in subparagraph (c) (1) (ii) of 252.227-7013; or (iii) Civilian agency contract; Use, reproduction or disclosure is subject to 52.227-19 (a) through (d) and the restrictions set forth in this license agreement. After your driver has been downloaded, follow these simple steps to install it.
Expand the archive file (if the download file is in zip or rar format).
If the expanded file has an .exe extension, double click it and follow the installation instructions.
Otherwise, open Device Manager by right-clicking the Start menu and selecting Device Manager.
Find the device and model you want to update in the device list.
Double-click on it to open the Properties dialog box.
From the Properties dialog box, select the Driver tab.
Click the Update Driver button, then follow the instructions.
Very important: You must reboot your system to ensure that any driver updates have taken effect.
