Software License Agreement

PLEASE READ THIS AGREEMENT CAREFULLY BEFORE INSTALLING THE SOFTWARE. BY INSTALLING THE SOFTWARE YOU AGREE TO BE BOUND
BY THE TERMS OF THIS AGREEMENT.  IF YOU DO NOT AGREE TO ALL OF 
THESE LICENSE TERMS, DO NOT INSTALL THIS SOFTWARE.

1. License.  You are hereby granted a non-exclusive License to use the accompanying computer software ("Software") and documentation ("Documentation") being supplied under this agreement on the following terms.

2. This License entitles you to:

a) Make one (1) copy of the Software solely for backup or archival purposes.

b) Use the Software on one computer at a time.  If such computer is accessible by other computers, you must purchase a License for each additional computer.

c) Transfer your rights under this License for the Software, provided that you give MicroTouch prior written notice of such transfer and that any transferee shall read and accept all the terms and conditions of this License.

3. Proprietary Rights.  This Software is protected by copyright pursuant to federal as well as international law. The Software also contains trade secrets proprietary to MicroTouch.  You acknowledge the foregoing and agree to reproduce MicroTouch's copyright notice and any other proprietary notices when the Software is copied.

4. Restrictions.  Subject to the provisions of federal law, you expressly agree not to:

a) Make or distribute copies of the Software in any form, directly or indirectly, without prior written agreement with MicroTouch to act as a License distributor.

b) Reverse engineer, disassemble, decompile, or otherwise reduce the Software to a human perceptible form, or otherwise attempt to recreate the source code.

c) Modify, adapt, sublicense, sell, lend, rent, or lease the Software.

d) Create any derivative work or incorporate the Software in any other work.

e) Remove or in any other way alter or obscure any copyright notice or other notice of proprietary rights of MicroTouch.

f) Use the Software on more than one computer without a prior multiple use License from MicroTouch.

g) Export the Software without full compliance with the rules and regulations of the Bureau of Export Administration.

If any provision of this License shall be inapplicable by law to any U.S. Government end-user, each such end-user acknowledges that the Software is Restricted Computer Software as defined in 48 CFR Chp. 1, Part 52.227-14 and -19 and as otherwise set out in the Federal Acquisition Regulations and the Restricted Rights Notice set forth therein is incorporated as part of this License as a restriction on each U.S. Government Licensee.

5. Severability and Termination.  If any part of this License is found unenforceable by a court, it shall be limited only to the extent necessary to make it enforceable, without otherwise affecting the License.  This License shall remain in effect until terminated. The License will be terminated immediately and without notice upon failure to comply with any of the provisions of this License Agreement.  Upon termination of this agreement, you must destroy all portions of the Software and Documentation.  You may terminate this License at your own discretion at any time by destroying the Software and all copies or returning the same to MicroTouch.

6. Warranty, Disclaimer, and Limitation of Liability.  THE SOFTWARE IS LICENSED IN "AS IS" CONDITION, AND EXCEPT AS SET FORTH HEREIN, MICROTOUCH MAKES NO WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. MICROTOUCH DISCLAIMS ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.  SOME STATES RESTRICT THE RIGHT TO EXCLUDE CERTAIN WARRANTIES, THEREFORE, THE RIGHTS YOU HAVE MAY VARY FROM STATE TO STATE.

The cost of setup and evaluation of the Software shall be borne by you.  MicroTouch shall have no liability beyond the obligations set forth above, and shall in no event be liable for any monetary damages, whether incidental, consequential, or otherwise, arising out of the use of the Software, irrespective of whether MicroTouch shall have been informed of the possibility of such damages.  Because some states do not allow the exclusion or limitation of liability for consequential or incidental damages, such limitation may not apply to you.

7. Title.  Title, ownership rights, and intellectual property rights in and to the Software and Documentation shall remain in MicroTouch and/or its suppliers.  The Software is protected by the copyright laws of the United States and international copyright treaties. Title, ownership rights, and intellectual property rights in and to the content accessed through the Software is the property of the applicable content owner and may be protected by applicable copyright or other law.  This License gives you no rights to such content.

8. Miscellaneous.  This Agreement represents the complete agreement concerning this License between the parties and supersedes all prior agreements and representations between them.  It may be amended only be a writing executed by both parties.  THE ACCEPTANCE OF ANY PURCHASE ORDER PLACED BY YOU IS EXPRESSLY MADE CONDITIONAL ON YOUR ASSENT TO THE TERMS SET FORTH HEREIN, AND NOT THOSE CONTAINED IN YOUR PURCHASE ORDER.

If any provision of this Agreement is held to be unenforceable for any reason, such provision shall be reformed only to the extent necessary to make it enforceable. This Agreement shall be governed by and construed under Massachusetts law as such law applies to agreements between Massachusetts residents entered into and to be performed within Massachusetts, except as governed by Federal law.  The application, the United Nations Convention of contracts for the International Sale of Goods, is expressly excluded.

How To Update Drivers Manually

After your driver has been downloaded, follow these simple steps to install it.

  • Expand the archive file (if the download file is in zip or rar format).

  • If the expanded file has an .exe extension, double click it and follow the installation instructions.

  • Otherwise, open Device Manager by right-clicking the Start menu and selecting Device Manager.

  • Find the device and model you want to update in the device list.

  • Double-click on it to open the Properties dialog box.

  • From the Properties dialog box, select the Driver tab.

  • Click the Update Driver button, then follow the instructions.

Very important: You must reboot your system to ensure that any driver updates have taken effect.
