LSI LOGIC FIBRE CHANNEL HBA API LICENSE AGREEMENT

PLEASE READ THE TERMS AND CONDITIONS OF THE FOLLOWING HBA API LICENSE AGREEMENT CAREFULLY BEFORE "CLICKING" ON ONE OF THE BUTTONS BELOW. THIS IS A LEGAL AGREEMENT BETWEEN YOU AND LSI LOGIC CORPORATION. BY "CLICKING" ON THE ACCEPT BUTTON BELOW, YOU HEREBY INDICATE YOUR ACCEPTANCE OF THESE TERMS AND CONDITIONS. IF YOU DO NOT AGREE WITH THESE TERMS AND CONDITIONS, "CLICK" ON THE "DO NOT ACCEPT" BUTTON.

1. Introduction.
This HBA API License Agreement ("Agreement") sets forth the terms on which you are permitted to use the LSI Logic Corporation Host Board Adapter (HBA) API and related documentation that you are about to download from this website and install (the "Licensed Materials"). After you agree to the terms and conditions of this Agreement, you will be allowed to install the Licensed Materials. This Agreement is not a transfer of rights, title or interest between LSI Logic Corporation ("LSI Logic") and you. Instead, this Agreement is a license that grants to you certain rights as outlined below.

2. Representation.
If you are an employee or agent, you represent and warrant that you have adequate legal capacity to enter into this Agreement on behalf of your employer or principal. As such, your employer or principal is bound by the terms and conditions of this agreement.

3. License.
The Licensed Materials contain and/or embody proprietary technology and intellectual property rights of LSI Logic and/or its licensors. The structure, organization and code that comprise the Licensed Materials are valuable trade secrets of LSI Logic or its licensors.  Subject to the provisions of this Agreement, LSI Logic grants you the limited, revocable, nontransferable, not sub licensable, royalty-free right and license to:

(a) Use and reproduce the Licensed Materials internally solely for the purpose of developing an interface between your storage area network management software application and an LSI Logic HBA; 
(b) Reproduce and distribute the Licensed Materials in conjunction with your storage area network management software application to end users of such application; and
(c) Sublicense to end-users the right to use the software portion of the Licensed Materials in conjunction with their use of your storage area network management software application.

LSI Logic and/or its licensors do not grant, convey or license to you any title or rights under any patents, copyrights or any other intellectual property rights except as specifically granted herein.  

You shall not modify, adapt, translate, reverse engineer, decompile, disassemble or otherwise attempt to discern the source code of the Licensed Materials.

All copies of the Licensed Materials will be subject to all terms and conditions of this Agreement.  Whenever you are permitted to copy or reproduce all or any part of the Licensed Materials, all titles, trademark symbols, copyright symbols and legends, and other proprietary markings must be reproduced.


4. Warranty Disclaimer.
 THE LICENSED MATERIALS ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, NONINFRINGEMENT OF THIRD PARTY RIGHTS AND FITNESS FOR A PARTICULAR PURPOSE. LSI LOGIC MAKES NO REPRESENTATIONS THAT THE LICENSED MATERIALS COMPLIES WITH THE APPLICABLE STATUTES, LAWS, REGULATIONS OR INDUSTRY STANDARDS.

The entire risk as to the quality and performance of the Licensed Materials is with you. Should the Licensed Materials prove defective, you (and not LSI Logic or its dealers or distributors or any licensor of LSI Logic or owner of the Licensed Materials) assume the entire cost of all necessary servicing, repair or correction. There is no warranty by LSI Logic to any other party or person that the functions contained in the Licensed Materials will meet your requirements or that the operation of the Licensed Materials will be uninterrupted or error free. You assume all responsibility for the selection of the Licensed Materials to achieve your intended results, and for the installation, use and results obtained from the Licensed Materials.

5. Limitation of Liability.
IN NO EVENT WILL LSI LOGIC OR ITS SUPPLIERS OR LICENSORS BE LIABLE TO YOU OR ANY OTHER PARTY FOR ANY DAMAGES, INCLUDING LOST PROFITS, LOST SAVINGS OR OTHER INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OR INABILITY TO USE THE LICENSED MATERIALS EVEN IF LSI LOGIC OR THE OTHER PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

6. General provisions.
No amendment or modification hereof will be valid or binding upon the parties unless made in writing and signed by the duly authorized representatives of both parties.  In the event that any provision or provisions of this Agreement will be held to be unenforceable, this Agreement will continue in full force and effect without said provision and will be interpreted to reflect the original intent of the parties.  This Agreement will be governed by the laws of the State of California, without regard to its conflict of laws principles.  The parties consent to the personal and exclusive jurisdiction of courts located in California.  You may not assign this Agreement (by operation of law or otherwise) without the prior written consent of LSI Logic and any prohibited assignment or sublicense will be null and void.  This Agreement will be binding upon and will inure to the benefit of the parties permitted successors and/or assignees.  Waiver by either party of a breach of any provision of this Agreement or the failure by either party to exercise any right hereunder will not operate or be construed as a waiver of any subsequent breach of that right or as a waiver of any other right This Agreement (including the Exhibits and any addenda hereto signed by both parties) contains the entire agreement of the parties with respect to the subject matter of this Agreement and supersedes all previous communications, representations, understandings and agreements, either oral or written, between the parties with respect to said subject matter.

How To Update Drivers Manually

After your driver has been downloaded, follow these simple steps to install it.

  • Expand the archive file (if the download file is in zip or rar format).

  • If the expanded file has an .exe extension, double click it and follow the installation instructions.

  • Otherwise, open Device Manager by right-clicking the Start menu and selecting Device Manager.

  • Find the device and model you want to update in the device list.

  • Double-click on it to open the Properties dialog box.

  • From the Properties dialog box, select the Driver tab.

  • Click the Update Driver button, then follow the instructions.

Very important: You must reboot your system to ensure that any driver updates have taken effect.
