1.   License.
 Subject to the terms and conditions of this EULA,
 Toshiba Memory Corporation (gToshibah) grants to you a non-exclusive,
 non-transferable and royalty-free license to use the Software only 
 with Toshiba solid state drive products (gSSDh).
 You shall not: copy or modify the Software; reverse compile,
 reverse engineer, disassemble or reverse assemble all or any 
 portion of the Software; rent, lease, 
 license, sublicense, distribute, transfer or sell the Software;
 or create derivative works of the Software.

2. Title.
 All right, title and interest to the Software, and any intellectual
 property right, including but not limited to, patent, trademark, 
 design patent, copyright, know-how and trade secret, 
 and application therefor (gIntellectual Property Righth) 
 to the Software shall remain in Toshiba. 

3. No Support.
 Toshiba and its affiliates shall not be obligated to support, 
 update or provide training for the Software. 
 Toshiba may update the Software at its sole discretion
 and without notice.      

4.  No Warranty.  
 YOU SHALL ACKNOWLEDGE THAT THE SOFTWARE WILL BE PROVIDED ON AN 
 gAS ISh BASIS WITHOUT ANY WARRANTY OR REPRESENTATION OF ANY KIND,
 WHETHER STATUTORY, EXPRESS OR IMPLIED, INCLUDING, 
 BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, 
 FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. 
 TOSHIBA AND ITS LICENSOR SHALL NOT BE LIABLE FOR ANY LIABILITY 
 (INCLUDING SPECIAL, CONSEQUENTIAL, INCIDENTAL, DIRECT OR INDERECT
  DAMAGE OR LIABILITY SUCH AS LOST RENEBUES OR PROFITS 
  AND LOSS OF DATA) ARISING FROM THE SOFTWARE EVEN IF  TOSHIBA HAS
  BEEB ADVISED OF THE POSSIBILITY OF SUCH DAMAGE OR LIABILITY.

5. Indemnity
 You agree to indemnify, defend and hold Toshiba and its affiliates
 harmless from and against any and all liabilities, damages, claims,
 expenses (including reasonable attorneyfs fees) associated with
 or arising out of your use of the Software, any actual 
 or alleged breach of this EULA by you, or any other matter relating
 to the Software, including but not limited to the use of any of
 third party license.

6. Limitation of Liability
 TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT 
 SHALL TOSHIBA AND ITS AFFILIATES BE LIABLE FOR ANY DIRECT,
 INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE OR CONSEQUENTIAL DAMAGES,
 INCLUDING BUT NOT LIMITED TO LOSS OF PROPERTY, LOSS OF DATA, 
 BUSINESS INTERRUPTION, COMPUTER SYSTEM FAILURE, MALFUNCTION,
 OR LOSS OF PROFITS RESULTING FROM USE OR INABILITY TO USE OF
 THE SOFTWARE, WHETHER A CLAIM FOR SUCH DAMAGES IS BASED UPON 
 WARRANTY, CONTRACT, TORT, NEGLIGENCE OR OTHERWISE, 
 EVEN IF TOSHIBA HAS BEEN ADVISED OF THE POSSIBILITY
 OF SUCH DAMAGES. IN NO EVENT SHALL TOSHIBAfS AGGREGATE LIABILITY 
 TO YOU IN CONNECTION WITH THE SOFTWARE SHALL EXCEED THE AMOUNT 
 PAID BY YOU UNDER THIS EULA.  

7. Unintended Use
 THE SOFTWARE IS NEITHER INTENDED NOR WARRANTED FOR USE IN EQUIPMENTS
 OR SYSTEMS THAT REQUIRE EXTRAORDINARILY HIGH LEVELS OF QUALITY 
 AND/OR RELIABILITY, AND/OR A MALFUNCTION OR FAILURE OF WHICH MAY
 CAUSE LOSS OF HUMAN LIFE, BODILY INJURY, SERIOUS PROPERTY DAMAGE
 AND/OR SERIOUS PUBLIC IMPACT ("UNINTENDED USE"). 
 Unintended Use includes, without limitation, equipment used 
 in nuclear facilities, equipment used in the aerospace industry,
 medical equipment, equipment used for automobiles, trains, 
 ships and other transportation, traffic signaling equipment,
 equipment used to control combustions or explosions, safety devices,
 elevators and escalators, devices related to electric power, 
 and equipment used in finance-related fields. 
 IF YOU USE THE SOFTWARE FOR UNINTENDED USE, TOSHIBA AND 
 ITS AFFILIATES ASSUME NO LIABILITY FOR THE SOFTWARE. 

8. Export Laws
 You shall not use or otherwise make the Software or its technology 
 for any military purposes, including without limitation, for the 
 design, development, use, stockpiling or manufacturing of nuclear,
 chemical, or biological weapons or missile technology products 
 (mass destruction weapons). 
 The Software and its technology may be controlled under 
 the applicable export laws and regulations including,
 without limitation, the Japanese Foreign Exchange and
 Foreign Trade ACT and the U.S. Export Administration Regulations.
 Export and re-export of the Software or its technology are
 strictly prohibited except in compliance 
 with all applicable export laws and regulations.

9. No Assignment
 Neither this EULA, nor any of the obligations or liabilities 
 of either party hereunder, may be assigned, transferred or 
 conveyed by either party by you to any party, by operation of law
 or otherwise, except upon the prior written consent of Toshiba.

10. Severability
 The invalidity or unenforceability of any provision of this
 EULA pursuant to any applicable law shall not affect
 the validity or enforceability of the remaining provisions 
 hereof, but this EULA shall be construed as if not containing 
 the provision held invalid or unenforceable in the jurisdiction 
 in which so held, unless, in the reasonable opinion of either party
 hereto, such invalid or unenforceable provisions comprise
 an integral part of, or are otherwise inseparable from 
 the remainder of, this EULA, in which case this EULA, 
 in such jurisdiction, shall immediately terminate and
 be of no further force and effect.

11. Termination
 This EULA may be immediately terminated by Toshiba upon your
 breach or failure in compliance with any part of 
 this EULA without prior notice to you.

12. Governing Law
 This EULA shall be governed by, and construed and enforced in 
 accordance with the laws of JAPAN. This EULA shall not be governed
 by Convention on International Sales of Goods.
 All disputes, controversies, or differences in connection with or
 arising out of this EULA that cannot be resolved by a mutually
 amicable arrangement between the parties hereto shall be finally
 settled according to the Rules of Conciliation and Arbitration 
 of the International Chamber of Commerce by three arbitrators
 appointed in accordance with the Rules.
 Arbitration proceedings shall be conducted in English language
 and shall take place in Tokyo, Japan.
 The decision of the arbitration proceedings shall be final 
 and binding upon both parties. Judgment on any arbitration
 decision may be entered in any court of competent jurisdiction.

13. Third Party Licenses
 This software includes third-party copyrighted software licensed under
 third-party licenses. Terms and conditions of each third-party license
 shall only apply to applicable Third-party Copyrighted Software. 
 With respect solely to third-party copyrighted software, 
 no warranty is provided, to the extent permitted by applicable law.

How To Update Drivers Manually

After your driver has been downloaded, follow these simple steps to install it.

  • Expand the archive file (if the download file is in zip or rar format).

  • If the expanded file has an .exe extension, double click it and follow the installation instructions.

  • Otherwise, open Device Manager by right-clicking the Start menu and selecting Device Manager.

  • Find the device and model you want to update in the device list.

  • Double-click on it to open the Properties dialog box.

  • From the Properties dialog box, select the Driver tab.

  • Click the Update Driver button, then follow the instructions.

Very important: You must reboot your system to ensure that any driver updates have taken effect.
