LICENSE TERMS AND CONDTIONS


The KODAK photo printer 6800/6850 Software ("Software") is available for use once you agree to the terms and conditions of this License.  This is a legal agreement between you, the end user, and Eastman Kodak Company and its affiliates (collectively "Kodak").  Please read the following terms and conditions carefully before installing or using the Software.  You will be asked to indicate your acceptance or rejection of the terms of this Agreement.  If you accept the terms and conditions of this License, you may use the Software subject to the terms contained below.  If you reject the terms, you must promptly return the Software and its packaging in their entirety.  

LICENSOR. This software product (the "Software") is licensed to you by either
Eastman Kodak Company ("Kodak") or the software manufacturer, if other than Kodak.  In some cases, Kodak has licensed from the manufacturer of the Software the right to distribute the Software, and is granting you a sublicense.

1. GRANT OF LICENSE.  You the purchaser shown on the accompanying order form ("Customer" or “Licensee”), have the non-exclusive right to use the Software on one or more computers, but only for the purpose of connecting to or interfacing with a Kodak printer.  You may copy the Software as necessary to enable you to use the Software as described above.  You may not distribute to third parties copies of the Software, or any written materials related to the Software ("Documentation") that are provided to you with the Software or subsequently from time to time by Kodak, to assist you in using the Software


2. RESTRICTIONS ON USE.  You may not use the Software other than as expressly   provided under this License.  All copies of the Software, in whole or in part,    including all updates and modifications to the Software in any form are the exclusive property of Kodak and no title to or ownership of the Software or any parts thereof are hereby transferred to Customer.  The Software constitutes proprietary and confidential information of Kodak and Customer agrees not to provide, disclose, or make available the Software or any part thereof to any third party without the prior written permission of Kodak.  Customer shall not use, print, copy, modify, translate, alter or display the Software in whole or in part except as expressly provided for in this Agreement.


3. COPYRIGHT.  The software and Documentation are protected by International copyright laws and  treaty provisions. Such copyright is owned by Kodak and its suppliers. In this clause “copyright” shall be deemed to include all related Intellectual Property Rights. You may not copy, reproduce, or distribute the Software other than as expressly provided in this license.  You may not reverse engineer, decompile, or disassemble the software


4. NO IMPLIED RIGHT. No right or license under any patent, copyright, trademark, or trade name of either party is granted to Licensee by, or is to be inferred from, any provision in this Agreement except as expressly provided herein.


5. TRANSFER.  You may permanently transfer the Software to another party if the other party agrees to accept the terms and conditions of this license and you retain no copies of the Software.


6. LIMITED WARRANTY.  Kodak warrants that for ninety (90) days following shipment of the Software to you, as documented by shipment date:  (1) the Software, will perform substantially in accordance with the functions described in the Documentation provided by Kodak; and (2) the media on which the Software is furnished will be free from defects in materials and workmanship under normal use.  

Kodak does not warrant that the Software will meet your requirements or that operation of the Software will be uninterrupted or error-free.  You assume responsibility for operation of the Software to achieve your intended results, and for the installation, use, and results obtained from the Software.  Kodak is not responsible for any problem, including any problem which would otherwise be a breach of warranty, caused by failures resulting from any (1) changes made in the operating characteristics of computer hardware or operating systems after the release of the Software; (2) interaction of the Software (including future versions of the software) with software not furnished by Kodak; (3) failure to follow Kodak's installation, operation or maintenance instructions for the Software; (4) modifications or alteration of the Software; (5) abuse, misuse, accidents, or negligent acts or omissions by you, your employees or agents, or by any third party; or (6) acts of nature. 

Subject to any applicable legislation which prohibits the following exclusions:  THE WARRANTY SET FORTH ABOVE IS THE ONLY WARRANTY MADE BY KODAK OR ITS LICENSORS WITH RESPECT TO THE SOFTWARE, THE DOCUMENTATION, AND ANY SUPPORT.  KODAK, ITS LICENSORS, ITS AFFILIATES, ITS SUPPORT PROVIDER, AND ITS SUPPLIERS MAKE NO OTHER WARRANTIES OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED, AND SPECIFICALLY DISCLAIM ANY WARRANTIES OR CONDITIONS OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OR NONINFRINGEMENT.

SOME LOCALITIES DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES OR CONDITIONS, OR HAVE LEGISLATION THAT IMPOSES CERTAIN STATUTORY WARRANTIES OR CONDITIONS THAT CANNOT BE EXCLUDED, SO THE ABOVE EXCLUSION MAY NOT APPLY TO YOU.  THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS.  YOU MAY HAVE OTHER RIGHTS WHICH VARY FROM LOCALITY TO LOCALITY.


7. LIMITATIONS OF REMEDIES.  Subject to any applicable legislation which prohibits the following limitations:  Kodak's entire liability and your exclusive remedy shall be, at Kodak's option, either (a) repair or replacement of the Software or any media not meeting Kodak's "Limited Warranty" that is returned to Kodak with proof of purchase, with a functionally equivalent program at no charge to you or (b) refund the price you paid for the license of the Software as reflected on your proof of purchase.  These remedies are not available if failure of the Software or media is the result of misuse, abuse or a failure to follow the operating instructions in the Documentation.  Any replacement Software will be warranted for the remainder of the original warranty period or thirty (30) days, whichever is longer.  Kodak will have no responsibility to replace or refund the license fee of Software damaged by accident, abuse, or misapplication.  REGARDLESS OF WHETHER ANY REMEDY SET FORTH HEREIN FAILS OF ITS ESSENTIAL PURPOSE, IN NO EVENT WILL KODAK OR ITS LICENSORS, OR THE DIRECTORS, OFFICERS, EMPLOYEES, OR AGENTS OF ANY OF THEM BE LIABLE TO YOU FOR ANY SPECIAL, CONSEQUENTIAL, INDIRECT, OR INCIDENTAL DAMAGES, INCLUDING ANY LOST PROFITS, LOST SAVINGS, LOST DATA OR OTHER DAMAGES ARISING OUT OF THE USE OR INABILITY TO USE THE SOFTWARE OR ANY DATA SUPPLIED WITH IT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.


8. LIMITATION OF LIABILITY.  THE ENTIRE RISK FOR USE AND PERFORMANCE OF THIS SOFTWARE IS ASSUMED BY YOU.  KODAK'S LIABILITY IS LIMITED, AS SET FORTH ABOVE, TO ITS OBLIGATION TO REPLACE DEFECTIVE CDS OR DOCUMENTATION OR TO REFUND THE LICENSE FEE ACTUALLY PAID BY YOU.  IN NO EVENT, WHETHER AS A RESULT OF BREACH OF CONTRACT, WARRANTY, CONDITION OR TORT (INCLUDING NEGLIGENCE AND STRICT LIABILITY), WILL KODAK, ITS AFFILIATES, ITS LICENSORS, OR THE DIRECTORS, OFFICERS, EMPLOYEES OR AGENTS OF ANY OF THEM, ITS SUPPORT PROVIDER OR ITS SUPPLIERS BE LIABLE FOR ANY DAMAGES, INCLUDING LOST PROFITS, LOST SAVINGS OR OTHER INCIDENTAL, INDIRECT, EXEMPLARY, SPECIAL, CONSEQUENTIAL OR OTHER DAMAGES, SUFFERED OR INCURRED BY YOU OR ANY OTHER PERSON AS A RESULT OF OR RELATED TO THE DELIVERY, USE OR PERFORMANCE OF THE SOFTWARE OR RESPONSES BY KODAK OR ITS SUPPORT PROVIDER TO YOUR INQUIRIES, EVEN IF KODAK WAS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.  UNDER NO CIRCUMSTANCES SHALL KODAK'S CUMULATIVE LIABILITY, OR THAT OF ITS LICENSORS, EXCEED THE  LICENSE FEE ACTUALLY PAID BY YOU.

SOME LOCALITIES DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.


9. TERMS AND TERMINATION.  You may terminate this license at any time by destroying the Software together with all copies in any form.  Additionally, this license will immediately terminate if you fail to comply with any term or condition of this License.  Upon termination of this License, for whatever reason, you agree to destroy the Software together with all copies in any form and you agree to provide Kodak with a written certification stating that all copies of the Software have been destroyed.


10. SUPPORT.  Kodak's support provider will answer questions about the use of the Software.  Support options accompany the order form for this product.  You reserve the right to select the support option which best fits your needs.  Installation of Software at Licensee's site shall be Licensee's responsibility.  It is the responsibility of the Licensee to have the computers configured and networked appropriately.


11. MISCELLANEOUS.  If the Software was purchased in the United States, this agreement shall be governed by the substantive laws of the State of New York.  If the Software was purchased in Canada, this Agreement shall be governed by the laws of the Province of Ontario (without reference to choice of law principles), and applicable Canadian federal law.  If purchased outside the United States and Canada, this Agreement is governed by the laws of the country in which it was purchased.  


12. EXPORT LAW ASSURANCES.  You agree that neither the Software nor any direct product thereof is being or will be acquired, shipped, transferred, or re-exported, directly or indirectly, into any country prohibited by the United States Export Administration Act and the regulations thereunder or will be used for any purpose prohibited by the same.


13. SEVERABILITY.  If for any reason, any provision or partial provision of this License is held invalid, such invalidity shall not affect the remainder of such provision or this License, and this License shall, to the full extent consistent with law, continue in full force and effect.


14. GOVERNMENT LICENSEE.  The Software and Documentation are provided with RESTRICTED RIGHTS.  Use, duplication, or disclosure by the Government is subject to restrictions as set forth in the Rights in Technical Data and Computer clause at 48 CFR 252.227-7013 and the Commercial Software-Restricted Rights clause at 48 CFR 52.227-19.  The contractor/manufacturer is Eastman Kodak Company, 343 State Street, Rochester, NY  14650.

15. EUROPEAN COMMUNITY PROVISIONS.  If this Software is used within a country of the European Union, nothing in this Agreement shall be construed as restricting any rights available under the European Community Software Directive (91/250/EEC).

How To Update Drivers Manually

After your driver has been downloaded, follow these simple steps to install it.

  • Expand the archive file (if the download file is in zip or rar format).

  • If the expanded file has an .exe extension, double click it and follow the installation instructions.

  • Otherwise, open Device Manager by right-clicking the Start menu and selecting Device Manager.

  • Find the device and model you want to update in the device list.

  • Double-click on it to open the Properties dialog box.

  • From the Properties dialog box, select the Driver tab.

  • Click the Update Driver button, then follow the instructions.

Very important: You must reboot your system to ensure that any driver updates have taken effect.
