LEIA ESTE DOCUMENTO CUIDADOSAMENTE. O UTILIZADOR TEM DE CONCORDAR COM OS TERMOS DO PRESENTE CONTRATO ANTES DE TRANSFERIR OU INSTALAR O SOFTWARE.

SE ESTIVER A PENSAR TRANSFERIR E UTILIZAR SOFTWARE DE TESTE A PARTIR DESTE SITE WEB OU A PARTIR DE UM CD, LEIA ESPECIFICAMENTE A SECÇÃO DENOMINADA "DISPOSIÇÕES ADICIONAIS SOBRE SOFTWARE DE TESTE", ALÉM DOS TERMOS E CONDIÇÕES AQUI INCLUÍDOS. NÃO TRANSFIRA NEM UTILIZE SOFTWARE DE TESTE ANTES DE TER LIDO E CONCORDADO COM OS TERMOS E CONDIÇÕES DO PRESENTE CONTRATO, INCLUINDO A SECÇÃO DENOMINADA "DISPOSIÇÕES ADICIONAIS SOBRE SOFTWARE DE TESTE".

Este documento constitui um contrato legal entre o utilizador e a Creative Technology Ltd e as suas subsidiárias ("Creative"). Este contrato contém os termos e condições ao abrigo dos quais a Creative se propõe conceder a licença relativa ao software e toda a documentação relacionada e demais artigos que acompanham o produto, incluindo, entre outros, programas executáveis, controladores, bibliotecas e ficheiros de dados associados aos referidos programas (colectivamente designados por Software).

LICENÇA
1. Concessão de licença
O Software é disponibilizado e não vendido, e a sua utilização encontra-se restringida aos termos do presente Contrato. Este Contrato de licença funciona como prova de licenciamento permitindo exercer os direitos aqui especificados e deve ser guardado pelas partes. O contrato é celebrado entre o utilizador e a Creative (e, onde aplicável, os seus representantes) e a Creative mantém todos os direitos e propriedade do Software e reserva-se todos os direitos que não foram expressamente concedidos ao utilizador. A Creative concede-lhe o direito de utilizar todo ou uma parte deste Software desde que
(a)  o Software não seja distribuído tendo em vista o lucro;
(b)  o Software seja utilizado apenas em conjunto com a gama de produtos da Creative;
(c)  o Software NÃO seja modificado; e
(d)  todos os avisos de direitos de autor sejam mantidos no Software.  

2. Utilização num único computador
O Software pode ser utilizado apenas num único computador e por um único utilizador. É permitida a transferência da parte do Software passível de leitura pelo sistema de um computador para outro computador, desde que
(a)  o Software (incluindo qualquer parte ou cópia do mesmo) seja eliminado do primeiro computador e
(b)  não exista qualquer possibilidade de que o Software seja utilizado em mais do que um computador simultaneamente.

3. Utilização independente
É permitida a utilização do Software apenas de forma independente, de tal modo que o Software e as funções por ele disponibilizadas possam ser acedidas apenas por pessoas fisicamente presentes no local de instalação do computador e do Software. É proibido o acesso remoto ao Software e respectivas funções, bem como a transmissão de toda ou qualquer parte do Software através de uma rede ou linha de comunicações.

4. Direitos de autor
O Software é da propriedade da Creative, e/ou respectivos representantes, e está protegido por leis de direitos de autor dos Estados Unidos e por tratados internacionais. É proibida a remoção ou alteração do aviso de direitos de autor das cópias do Software ou das cópias da documentação que acompanhem o Software. Para além dos direitos expressamente estabelecidos no presente, este Contrato não concede quaisquer direitos de propriedade intelectual sobre o Software ao utilizador. Todos os direitos que não sejam expressamente concedidos pela Creative são reservados pela Creative e/ou respectivos representantes.

5. Uma Cópia de segurança (A Secção 5 não se aplica a Software de Teste)
É permitida a execução de uma (1) cópia de segurança da parte do Software passível de leitura pelo sistema e apenas como recurso da utilização do Software num único computador, e desde que sejam reproduzidos na cópia todos os avisos de direitos de autor e de propriedade que se encontram nos originais do Software.

6. Proibição de fusões e integrações
É proibida a fusão de qualquer parte do presente Software com outro programa, bem como a sua integração noutro programa, excepto na medida em que tal seja permitido pela legislação da jurisdição na qual o Software esteja a ser utilizado. Qualquer parte do Software que se encontre fundida com outro programa ou nele integrada continuará a estar sujeita aos termos e condições do presente Contrato, devendo ser reproduzidos no novo programa todos os avisos de direitos de autor e de propriedade incluídos nos originais do Software.

7. Versão para rede
Se tiver sido adquirida uma versão do Software para utilização em rede, o presente Contrato aplica-se à instalação do Software num único "servidor de ficheiros". Não pode ser copiado para múltiplos sistemas. Cada "nó" da rede ligado ao "servidor de ficheiros" deve possuir também uma licença própria de "cópia de nó", que constitui uma licença apenas para efeitos do "nó" em questão.
	
8. A transferência da licença não é permitida
O utilizador não pode transferir a licença do Software que lhe foi atribuída para terceiros.

9. Limitações à utilização, cópia e modificação do Software
Salvo na medida expressamente permitida pelo presente Contrato ou pelas leis da jurisdição na qual o Software tenha sido adquirido, não é permitido utilizar, copiar ou modificar o Software. Está igualmente vedado o sub-licenciamento de qualquer dos direitos do utilizador emergentes do presente Contrato. Pode utilizar este software apenas para uso pessoal e não para divulgação pública ou para a criação de cassetes de vídeo para apresentação em público.
	
10. Descompilação, desassemblagem ou retro-engenharia
O utilizador reconhece que o Software contém segredos industriais e outras informações de propriedade da Creative e seus representantes. Excepto nos casos expressamente indicados no presente Contrato ou pela legislação da jurisdição na qual o Software esteja a ser utilizado, não poderá descompilar, desassemblar ou proceder à retro-engenharia do Software, nem efectuar outros procedimentos com vista à obtenção de informações ocultas que não se encontrem visíveis para o utilizador aquando da utilização normal do Software.

Em particular, o utilizador obriga-se a não transmitir nem divulgar o código-objecto do Software em qualquer ecrã de computador, bem como a não o transpor da memória do Software para papel. Mesmo que o utilizador considere ter necessidade de informações relacionadas com a interoperacionalidade entre o Software e outros programas, não poderá descompilar nem desassemblar o Software para as obter. Mais concorda em solicitar as informações pertinentes à Creative, dirigindo o seu pedido para o endereço indicado anteriormente. Ao receber tal pedido, caberá à Creative determinar se deve disponibilizar essas informações ao utilizador.

De qualquer forma, deverá notificar a Creative de quaisquer informações resultantes de procedimentos de retro-engenharia ou actividades semelhantes, e os resultados desse tipo de procedimentos passarão a fazer parte das informações confidenciais da Creative, podendo apenas ser utilizados em relação ao Software.

11. Termos de utilização da Gracenote(R) CDDB(R)
Esta aplicação pode conter software da Gracenote, Inc. de Emeryville, Califórnia ("Gracenote"). O software da Gracenote (o "Cliente Gracenote") permite que esta aplicação efectue uma identificação online do disco e dos ficheiros de música e obtenha as informações relacionadas com música, incluindo o nome, o artista, a faixa e o título ("Dados da Gracenote") a partir de servidores online ("Servidores da Gracenote") e execute outras funções. Só pode utilizar os Dados da Gracenote para as funções de Utilizador Final deste software de aplicação.

O utilizador reconhece e concorda que a Creative não efectua qualquer representação, compromisso ou garantia, de forma expressa ou implícita ou outra, relativamente ao fornecimento, continuidade no fornecimento e/ou utilização do Cliente Gracenote, dos Dados Gracenote ou do Servidor Gracenote ou dos materiais relacionados. O utilizador concorda especificamente que a Creative não garante o acesso do utilizador aos serviços da Gracenote durante a vigência do presente Contrato.

O utilizador reconhece e concorda, ainda, que a Creative não será responsável, nem se responsabiliza, directa ou directamente, por quaisquer danos ou perdas causados, ou alegadamente causados, ou relacionados com a utilização ou incapacidade para utilizar o Cliente Gracenote, os Dados Gracenote ou o Servidor Gracenote ou materiais relacionados.  

Deverá comprometer-se a utilizar os Dados da Gracenote, o Cliente Gracenote e os Servidores Gracenote exclusivamente para o seu uso próprio e não comercial. O utilizador concorda em não atribuir, copiar, transferir nem transmitir o Cliente Gracenote ou quaisquer Dados da Gracenote (excepto quando se encontrem num identificador associado a um ficheiro de música) a terceiros. O UTILIZADOR COMPROMETE-SE A NÃO UTILIZAR OU EXPLORAR OS DADOS DA GRACENOTE, O CLIENTE GRACENOTE OU OS SERVIDORES GRACENOTE A NÃO SER NAS CONDIÇÕES EXPRESSAMENTE PREVISTAS NO PRESENTE DOCUMENTO. 

Deverá aceitar que a sua licença de utilização não exclusiva dos Dados da Gracenote, do Cliente Gracenote e dos Servidores Gracenote cessará em caso de incumprimento das restrições indicadas. Se a licença cessar, o utilizador concorda em terminar toda e qualquer utilização dos Dados, do Cliente Gracenote e dos Servidores da Gracenote. A Gracenote reserva-se todos os direitos relativamente aos Dados, ao Cliente Gracenote e aos Servidores da Gracenote, incluindo todos os direitos de propriedade. Em nenhuma circunstância poderá a Gracenote ser responsabilizada por qualquer pagamento ao utilizador por qualquer informação fornecida, incluindo informações sobre ficheiros de música. O utilizador aceita que a Gracenote possa accionar judicialmente os seus direitos ao abrigo do presente contrato contra si, em seu próprio nome.

O Serviço Gracenote utiliza um identificador exclusivo para registar as consultas para efeitos estatísticos. O objectivo deste identificador numérico aleatório é permitir ao serviço Gracenote contabilizar as consultas efectuadas sem receber qualquer informação pessoal sobre o utilizador. Para mais informações, visite a página web no endereço www.gracenote.com e consulte a Política de Privacidade da Gracenote correspondente ao Serviço Gracenote em questão.

O Cliente Gracenote e todos os elementos dos Dados da Gracenote são licenciados ao utilizador "TAL COMO ESTÃO". A Gracenote não efectua representações nem garantias, expressas ou implícitas, relacionadas com a exactidão de todos os Dados da Gracenote contidos nos Servidores da Gracenote. A Gracenote reserva-se o direito de eliminar dados dos Servidores da Gracenote ou de alterar as categorias de dados por qualquer motivo que julgue suficiente. Não é efectuada nenhuma garantia em como o Cliente Gracenote ou os Servidores da Gracenote estão isentos de erros ou que o funcionamento do Cliente Gracenote ou dos Servidores Gracenote seja ininterrupto. A Gracenote não se compromete a fornecer ao utilizador quaisquer tipos de dados melhorados ou adicionais que a Gracenote possa vir a fornecer futuramente, podendo retirar livremente do mercado os seus serviços online em qualquer momento. A GRACENOTE RECUSA QUAISQUER GARANTIAS, EXPRESSAS OU IMPLÍCITAS, INCLUINDO MAS NÃO SE LIMITANDO A, GARANTIAS IMPLÍCITAS DE ADEQUAÇÃO À COMERCIALIZAÇÃO, ADEQUAÇÃO A UM FIM ESPECÍFICO, TÍTULO E NÃO INFRACÇÃO. A Gracenote não garante os resultados obtidos através da utilização do Cliente Gracenote ou Servidor da Gracenote por parte do utilizador. EM CASO ALGUM PODERÁ A GRACENOTE SER RESPONSABILIZADA POR QUAISQUER DANOS INDIRECTOS OU ACIDENTAIS, NEM POR QUALQUER PERDA DE LUCROS OU RENDIMENTOS. 

12. CESSAÇÃO
A licença concedida é válida até à cessação do contrato. O utilizador pode cessar o Contrato em qualquer momento, destruindo o Software (incluindo partes ou cópias do mesmo) que se encontra na sua posse ou controlo. A licença cessa automaticamente sem necessidade de aviso prévio por parte da Creative se o utilizador não observar qualquer dos termos ou condições incluídos neste Contrato. Em caso de cessação, o utilizador obriga-se a destruir o Software (incluindo partes ou cópias do mesmo, se for caso disso). A Creative pode ainda fazer uso, no momento da cessação, de todos os direitos que lhe sejam conferidos pela lei. As disposições do presente Contrato que protegem os direitos de propriedade da Creative continuarão em vigor após a cessação.

13. SEM GARANTIA
A UTILIZAÇÃO DESTE SOFTWARE DECORRE POR SUA CONTA E RISCO. O SOFTWARE FOI CONCEBIDO PARA SER UTILIZADO APENAS COM O HARDWARE DA CREATIVE E SOFTWARE RELACIONADO. O SOFTWARE É FORNECIDO TAL COMO ESTÁ SEM GARANTIA DE NENHUM TIPO. A CREATIVE RECUSA QUAISQUER GARANTIAS DE QUALQUER TIPO, NA MEDIDA DO MÁXIMO PERMITIDO POR LEI, EXPRESSAS OU IMPLÍCITAS, INCLUINDO, MAS NÃO SE LIMITANDO A, GARANTIAS IMPLÍCITAS OU CONDIÇÕES DE COMERCIALIZAÇÃO OU ADEQUAÇÃO A UMA DETERMINADA FINALIDADE, TÍTULO OU NÃO INFRACÇÃO. A CREATIVE NÃO É OBRIGADA A FORNECER QUAISQUER ACTUALIZAÇÕES DO SOFTWARE.

Nenhum distribuidor, fornecedor ou qualquer outra entidade ou pessoa se encontra autorizada a alargar ou alterar esta garantia ou quaisquer outras disposições do presente Contrato. A Creative não garante que as funções contidas no Software satisfaçam os requisitos do utilizador nem que o funcionamento do Software seja ininterrupto ou isento de erros ou código malicioso. Neste parágrafo, "código malicioso" aplica-se a código de programação concebido para contaminar outros programas ou dados informáticos, consumir os recursos informáticos, modificar, destruir, gravar ou transmitir dados ou, de qualquer outra forma, deturpar o normal funcionamento do computador, sistema informático ou rede informática, incluindo os vírus, "cavalos de Tróia", droppers, worms, bombas lógicas e semelhantes. 

Qualquer representação, para além das garantias apresentadas no presente Contrato, não são aceites pela Creative. O utilizador responsabiliza-se pela selecção do Software necessário à satisfação dos resultados pretendidos, bem como pela transferência, utilização e resultados obtidos com o Software. Compete também ao utilizador assumir todos os riscos associados à qualidade e desempenho do Software. No caso de o Software se apresentar defeituoso, o utilizador (e não a Creative, seus distribuidores ou revendedores) assume o custo integral de quaisquer serviços de assistência, reparação ou correcção.

A Creative não se responsabiliza pela exactidão das informações fornecidas pela Creative ou pelos técnicos de assistência de terceiros ou por quaisquer danos provocados directa ou indirectamente por acções ou omissões do utilizador como consequência dessa mesma assistência técnica. 

Esta garantia proporciona ao utilizador direitos legais específicos, bem como outros direitos que podem variar de país/estado para país/estado. Alguns países ou estados não permitem a exclusão de garantias implícitas, pelo que a exclusão supra pode não ser aplicável. A Creative não se responsabiliza por quaisquer garantias se o Software tiver sido personalizado, reacondicionado ou de outra forma alterado por terceiros.
 
14. RENÚNCIA À RESPONSABILIDADE POR DANOS: LIMITAÇÃO DE RESPONSABILIDADE (A Secção 14 não se aplica a Software de Teste. Consulte a Cláusula C na Secção "Disposições Adicionais para Software de Teste".)
EM CASO ALGUM SERÁ A CREATIVE OU OS SEUS REPRESENTANTES RESPONSÁVEIS POR QUAISQUER DANOS (INCLUINDO, SEM LIMITAÇÕES, DANOS ACIDENTAIS, DIRECTOS, ESPECIAIS OU CONSEQUENCIAIS, OU QUAISQUER DANOS FÍSICOS (INCLUINDO MORTE) A QUALQUER PESSOA CAUSADOS POR NEGLIGÊNCIA DA CREATIVE, PERDA DE LUCRO, INTERRUPÇÃO DA ACTIVIDADE, PERDA DE INFORMAÇÕES SOBRE O NEGÓCIO OU OUTRA PERDA PECUNIÁRIA) RESULTANTES DA UTILIZAÇÃO OU INCAPACIDADE PARA UTILIZAR ESTE SOFTWARE, MESMO QUE A CREATIVE OU OS SEUS REPRESENTANTES TENHAM SIDO ADVERTIDOS DA POSSIBILIDADE DE TAIS DANOS. EM CIRCUNSTÂNCIA ALGUMA PODERÁ A RESPONSABILIDADE DA CREATIVE, OU A COMPENSAÇÃO DEVIDA AO UTILIZADOR OU A QUALQUER OUTRA ENTIDADE, EXCEDER O MONTANTE PAGO PELO UTILIZADOR PELO USOS DO SOFTWARE, INDEPENDENTEMENTE DA FORMA OU NATUREZA DA RECLAMAÇÃO. DADO QUE ALGUNS ESTADOS/PAÍSES NÃO PERMITEM A EXCLUSÃO OU LIMITAÇÃO DE RESPONSABILIDADES POR DANOS CONSEQUENCIAIS OU ACIDENTAIS, AS LIMITAÇÕES ESPECIFICADAS PODEM NÃO SER APLICÁVEIS.

15. INDEMNIZAÇÃO A SER PAGA POR SI
Se distribuir o Software em condições que violem o presente Contrato, deverá indemnizar, isentar e defender a Creative de quaisquer reclamações ou processos legais, incluindo custos e honorários de advogados que possam surgir, resultar ou estar ligados à utilização ou distribuição do Software em condições que violam o presente Contrato.

16. DIREITOS RESTRITOS DO GOVERNO DOS EUA
Todo o Software e documentação relacionada são fornecidos com restrição de direitos. A sua utilização, duplicação ou divulgação pelo governo dos EUA está sujeita a restrições, tal como se encontra disposto na subdivisão (b)(3)(ii) de "Rights in Technical Data and Computer Software Clause", 252.227-7013. No caso de sublicenciamento ou utilização do Software fora dos Estados Unidos, devem ser observadas as leis do país em questão, a legislação que rege o controlo de exportações dos EUA e a versão em língua inglesa do presente Contrato.

18. DISPOSIÇÕES GERAIS
O presente Contrato obriga o utilizador e ainda os seus empregados, entidade patronal, empresas colaborando sob contrato, bem como quaisquer sucessores e cessionários. Nem o Software nem quaisquer informações nele contidas podem ser exportados excepto em estrita observância da legislação dos EUA e de outras disposições aplicáveis. O presente Contrato rege-se pelas leis do Estado da Califórnia (excepto no que a legislação federal determina em termos de direitos de autor e de marcas registadas a nível federal). O presente Contrato constitui a totalidade do acordo entre as partes e o utilizador concorda que a Creative não pode ser responsabilizada por quaisquer declarações ou representações inexactas (resultantes de mera culpa, involuntárias ou de negligência) emitidas pela Creative, seus agentes ou qualquer outra entidade, nas quais o utilizador tenha feito fé no momento da celebração do Contrato, salvo se as referidas declarações ou representações se revestirem de carácter doloso. O presente Contrato sobrepõe-se a quaisquer outros compromissos ou acordos, incluindo, mas não se limitando a publicidade, relativa ao Software.

Caso alguma disposição do presente Contrato seja declarada inválida ou não aplicável por qualquer país ou organismo governamental competente para o efeito, tal disposição considerar-se-á alterada no que seja estritamente necessário para a tornar válida e aplicável, sem prejuízo das restantes disposições, que se manterão válidas e aplicáveis.

Para questões relativas ao presente Contrato, é favor contactar a Creative no endereço atrás indicado. Para questões sobre o produto ou assuntos de natureza técnica, é favor contactar o centro de assistência técnica Creative mais próximo.

Este pacote pode incluir software com funcionalidade de DVD-Áudio para a reprodução de discos áudio-DVD de conteúdo protegido. A funcionalidade deste Software poderá perder-se se o sistema de protecção do conteúdo for comprometido. Neste caso, a única solução para restaurar a funcionalidade será transferir uma actualização do produto a partir do site Web da Creative.

ADENDA AO CONTRATO DE LICENÇA DE SOFTWARE MICROSOFT

IMPORTANTE: A utilização dos ficheiros de software da Microsoft (o "Software Microsoft"), fornecidos com esta Adenda, implica a aceitação, por parte do utilizador, dos termos e condições infra. Se não concordar em ser obrigado pelos referidos termos e condições, não está habilitado a utilizar o Software Microsoft.

O Software Microsoft é fornecido com o único objectivo de substituir os ficheiros correspondentes fornecidos com um exemplar anteriormente licenciado do produto de software Microsoft ("PRODUTO ORIGINAL"). No momento da respectiva instalação, os ficheiros do Software Microsoft tornam-se parte integrante do PRODUTO ORIGINAL e ficam sujeitos aos mesmos termos e condições, relativos a garantia e licença, do PRODUTO ORIGINAL. Se não tiver uma licença válida para utilizar o PRODUTO ORIGINA, não pode utilizar o Software Microsoft. É proibida qualquer outra utilização do Software Microsoft.

Nada no presente Contrato deve ser interpretado, sob o ponto de vista da Creative, como advogando ou autorizando a violação das leis locais e/ou internacionais aplicáveis à sua jurisdição

ADENDA DE GESTÃO DE DIREITOS DIGITAIS (DRM)
===============
A seguinte adenda aplica-se aos produtos que contêm a tecnologia de gestão de direitos digitais Windows Media (WMDRM).

Os proprietários de conteúdos utilizam a tecnologia de gestão de direitos digitais Windows Media (WMDRM) para proteger a respectiva propriedade intelectual, incluindo direitos de autor. Este dispositivo utiliza software WMDRM para aceder a conteúdos protegidos por WMDRM. Caso o software WMDRM não proteja o conteúdo, os proprietários do mesmo podem solicitar à Microsoft que anule a capacidade do software para utilizar WMDRM para reproduzir ou copiar conteúdos protegidos. Esta anulação não afecta conteúdos não protegidos. Quando transfere licenças de conteúdos protegidos, o utilizador concorda que a Microsoft pode incluir uma lista de anulações juntamente com as licenças. Os proprietários de conteúdos podem exigir a actualização do software WMDRM para permitir que o utilizador aceda aos respectivos conteúdos. Caso recuse a actualização, o utilizador não poderá aceder aos conteúdos que exigem a actualização. 

INFORMAÇÕES DE DIREITOS DE AUTOR PARA OS UTILIZADORES DOS PRODUTOS DA CREATIVE

Certos produtos da Creative foram concebidos para o ajudar na reprodução de material em relação ao qual seja proprietário dos direitos de autor ou esteja autorizado pelo proprietário dos direitos de autor a copiar ou ainda que esteja isento ao abrigo da lei aplicável. A não ser que seja detentor dos direitos de autor ou dessa autorização, poderá estar a violar a lei de direitos de autor e poderá ficar sujeito ao pagamento de indemnização por danos e outras compensações. Se não tiver a certeza relativamente aos seus direitos, deverá contactar o seu advogado. 

É da sua responsabilidade durante a utilização de um produto da Creative assegurar-se de que não são infringidas as leis de direitos de autor aplicáveis e segundo as quais antes de se proceder à cópia de certos materiais pode ser necessária a obtenção de uma autorização prévia dos proprietários dos direitos de autor. A Creative rejeita qualquer responsabilidade relativamente a uma utilização ilegal do produto da Creative e a Creative não será em circunstância alguma responsável relativamente à origem de quaisquer dados armazenados num ficheiro áudio compactado. 

O utilizador reconhece e concorda que a exportação ou utilização de Codecs MP3 que podem estar incluídos no software, com difusão em tempo real (por via terrestre, por satélite, por cabo ou por outro meio) ou difusão através da Internet ou outras redes, incluindo, entre outras, as intranets, em aplicações de áudio pago ou de pagamento mediante pedido, não são autorizadas e/ou licenciadas.

DISPOSIÇÕES ESPECIAIS APLICÁVEIS NA UNIÃO EUROPEIA

Se o software tiver sido transferido na União Europeia (UE), são também aplicáveis as disposições que se seguem. Em caso de conflito entre os termos do contrato de licença do software atrás exposto e as disposições que a seguir se apresentam, estas PREVALECEM.

Descompilação:
O utilizador obriga-se a não transmitir nem divulgar, quaisquer que sejam as circunstâncias, o código-objecto do Software em qualquer ecrã de computador, bem como a não o transpor da memória do Software para papel. Mesmo que o utilizador considere ter necessidade de informações relacionadas com a interoperacionalidade entre o Software e outros programas, não poderá descompilar nem desassemblar o Software para as obter. Mais concorda em solicitar as informações pertinentes à Creative, dirigindo o seu pedido para o endereço indicado anteriormente. Caberá à Creative, ao receber tal pedido, determinar se as informações solicitadas se destinam a preencher uma finalidade legítima e, em caso afirmativo, fornecê-las ao utilizador mediante condições e dentro de um prazo considerados razoáveis.

GARANTIA LIMITADA:

AS LIMITAÇÕES DE RESPONSABILIDADE E DANOS RELATIVAS AO CONTRATO DE LICENÇA DO SOFTWARE NÃO SE APLICAM A DANOS PESSOAIS (INCLUINDO MORTE) CAUSADOS POR NEGLIGÊNCIA DA CREATIVE E ESTÃO SUJEITAS ÀS DISPOSIÇÕES APRESENTADAS EM SEGUIDA SOB O TÍTULO "DIREITOS ESTATUTÁRIOS".

Direitos estatutários:
A legislação da República da Irlanda prevê que determinadas condições e garantias possam estar implícitas em contratos relativos à venda de bens e ao fornecimento de serviços. Essas condições e garantias são, pelo presente, excluídas, desde que, no contexto da presente transacção, essa exclusão se enquadre na legislação da República da Irlanda. Paralelamente, essas condições e garantias, na medida em que não possam ser legalmente excluídas, continuarão a ser aplicáveis. Assim, nada no teor do presente Contrato poderá restringir quaisquer direitos que assistam ao utilizador ao abrigo das Secções 12, 13, 14 ou 15 da lei irlandesa de venda de bens de 1893 (Irish Sale of Goods Act 1893) (incluindo os respectivos aditamentos e emendas).

Disposições gerais:
O presente Contrato rege-se pelas leis da República da Irlanda. A versão na língua local do presente Contrato aplicar-se-á ao Software transferido na UE. O presente Contrato constitui a totalidade do acordo entre as partes e o utilizador concorda que a Creative não pode ser responsabilizada por quaisquer declarações ou representações inexactas (resultantes de mera culpa, involuntárias ou de negligência) emitidas pela Creative, seus agentes ou qualquer outra entidade, nas quais o utilizador tenha feito fé no momento da celebração do Contrato, salvo se as referidas declarações ou representações se revestirem de carácter doloso.

DISPOSIÇÕES ADICIONAIS SOBRE SOFTWARE DE TESTE

A. Instalação e Direitos de Utilização
O utilizador só pode instalar o Software de Teste uma única vez por dispositivo (apenas em formato de código-objecto). O utilizador está autorizado a usar o Software de Teste apenas num único dispositivo ao mesmo tempo (3 dispositivos no máximo, mas apenas um dispositivo de cada vez). A utilização simultânea do Software de Teste em mais de um dispositivo não é autorizada ao abrigo da presente licença. O utilizador só pode usar o Software de Teste para avaliação interna para fins pessoais. Não são concedidos ao utilizador quaisquer direitos para utilização do Software de Teste para fins comerciais ou para obtenção de lucros, seja de que forma for.

B. Período de Teste
O Software de Teste tem um dispositivo de registo incorporado que permite que o Software de Teste seja activado pelo período de tempo especificado na página Web da transferência ao instalar o Software de Teste (incluindo a data da instalação - "Período de teste"). No final do Período de Teste, se optar por não adquirir o Software, o Software de Teste será desactivado e o utilizador não está autorizado a usar o Software de Teste após o Período de Teste. O utilizador pode não receber qualquer aviso de que o Software de Teste irá ser desactivado ou expirar no final do Período de Teste. Caso decida não adquirir o Software de Teste, o utilizador deverá desinstalar o Software de Teste do respectivo dispositivo; caso contrário, o software irá permanecer no dispositivo mesmo depois da sua desactivação. Pode não ser possível aceder a dados utilizados com o Software de Teste após a sua desactivação. A Creative e as respectivas afiliadas não serão, de qualquer forma, responsáveis por qualquer perda de dados ou informações ou por qualquer outra discrepância resultante da desactivação do Software de Teste.

C. RENÚNCIA À RESPONSABILIDADE POR DANOS: TERMO DE RESPONSABILIDADE
EM CASO ALGUM SERÁ A CREATIVE OU OS SEUS REPRESENTANTES RESPONSÁVEIS POR QUAISQUER DANOS (INCLUINDO, SEM LIMITAÇÕES, DANOS ACIDENTAIS, DIRECTOS, ESPECIAIS OU CONSEQUENCIAIS, OU QUAISQUER DANOS FÍSICOS (INCLUINDO MORTE) A QUALQUER PESSOA CAUSADOS POR NEGLIGÊNCIA DA CREATIVE, PERDA DE LUCRO, INTERRUPÇÃO DA ACTIVIDADE, PERDA DE INFORMAÇÕES SOBRE O NEGÓCIO OU OUTRA PERDA PECUNIÁRIA) RESULTANTES DO PRESENTE CONTRATO OU DA UTILIZAÇÃO OU INCAPACIDADE PARA UTILIZAR ESTE SOFTWARE DE TESTE, MESMO QUE A CREATIVE OU OS SEUS REPRESENTANTES TENHAM SIDO ADVERTIDOS DA POSSIBILIDADE DE TAIS DANOS. PLEASE READ THIS DOCUMENT CAREFULLY. YOU MUST AGREE TO THE TERMS OF THIS AGREEMENT BEFORE DOWNLOADING OR INSTALLING THE SOFTWARE.

IF YOU ARE PLANNING TO DOWNLOAD AND USE TRIAL SOFTWARE FROM THIS WEBSITE OR FROM A CD, PLEASE SPECIFICALLY READ THROUGH THE SECTION TITLED "ADDITIONAL PROVISIONS FOR TRIAL SOFTWARE" IN ADDITION TO THE TERMS AND CONDITIONS CONTAINED HEREUNDER. This is a legal agreement between you and Creative Technology Ltd and its subsidiaries ("Creative"). This Agreement states the terms and conditions upon which Creative offers to license the software together with all related documentation and accompanying items including, but not limited to, the executable programs, drivers, libraries and data files associated with such programs (collectively, the "Software").

LICENSE
1. Grant of License
The Software is licensed, not sold, to you for use only under the terms of this Agreement. This License Agreement is your proof of license to exercise the rights granted herein and must be retained by you. As between you and Creative (and, to the extent applicable, its licensors), Creative retains all title to and ownership of the Software and reserves all rights not expressly granted to you. Creative grants to you the right to use all or a portion of this Software provided that 
(a) the Software is not distributed for profit;
(b) the Software is used only in conjunction with Creative's family of products;
(c) the Software is NOT modified; and 
(d) all copyright notices are maintained on the Software.  

2. For Use on a Single Computer
The Software may be used only on a single computer by a single user at any time. You may transfer the machine-readable portion of the Software from one computer to another computer, provided that
(a) the Software (including any portion or copy thereof) is erased from the first computer and 
(b) there is no possibility that the Software will be used on more than one computer at a time.

3. Stand-Alone Basis
You may use the Software only on a stand-alone basis, such that the Software and the functions it provides are accessible only to persons who are physically present at the location of the computer on which the Software is loaded. You may not allow the Software or its functions to be accessed remotely, or transmit all or any portion of the Software through any network or communication line.

4. Copyright
The Software is owned by Creative and/or its licensors, and is protected by United States copyright laws and international treaty provisions. You may not remove or alter the copyright notice from any copy of the Software or any copy of the written materials, if any, accompanying the Software. Other then the rights expressly set forth herein, this Agreement does not grant you any intellectual property rights in the Software. All rights not expressly granted by Creative are reserved by Creative and/or its licensors.

5. One Archival Copy (Section 5 shall not apply to Trial Software)
You may make one (1) archival copy of the machine-readable portion of the Software for backup purposes only in support of your use of the Software on a single computer, provided that you reproduce on the copy all copyright and other proprietary rights notices included on the originals of the Software.

6. No Merger or Integration
You may not merge any portion of the Software into, or integrate any portion of the Software with, any other program, except to the extent expressly permitted by the laws of the jurisdiction where you are located. Any portion of the Software merged into or integrated with another program, if any, will continue to be subject to the terms and conditions of this Agreement, and you must reproduce on the merged or integrated portion all copyright and other proprietary rights notices included on the originals of the Software.

7. Network Version
If you have purchased a "network" version of the Software, this Agreement applies to the installation of the Software on a single "file server". It may not be copied onto multiple systems. Each "node" connected to the "file server" must also have its own license of a "node copy" of the Software, which becomes a license only for that specific "node".
	
8. No Transfer of License
You may not transfer your license of the Software to a third party.

9. Limitations on Using, Copying, and Modifying the Software
Except to the extent expressly permitted by this Agreement or by the laws of the jurisdiction where you acquired the Software, you may not use, copy or modify the Software. Nor may you sub-license any of your rights under this Agreement. You may use the Software for your personal use only, and not for public performance or for the creation of publicly displayed videotapes.
	
10. Decompiling, Disassembling, or Reverse Engineering
You acknowledge that the Software contains trade secrets and other proprietary information of Creative and its licensors. Except to the extent expressly permitted by this Agreement or by the laws of the jurisdiction where you are located, you may not decompile, disassemble or otherwise reverse engineer the Software, or engage in any other activities to obtain underlying information that is not visible to the user in connection with normal use of the Software.

In particular, you agree not to transmit the Software or display the Software's object code on any computer screen or to make any hardcopy memory dumps of the Software's object code. If you believe you require information related to the interoperability of the Software with other programs, you shall not decompile or disassemble the Software to obtain such information, and you agree to request such information from Creative at the address listed below. Upon receiving such a request, Creative shall determine in its sole discretion whether to provide such information to you.

In any event, you will notify Creative of any information derived from reverse engineering or such other activities, and the results thereof will constitute the confidential information of Creative that may be used only in connection with the Software.

11. Gracenote(R) CDDB(R) Terms of Use
This application may contain software from Gracenote, Inc. of Emeryville, California ("Gracenote"). The software from Gracenote (the "Gracenote Client") enables this application to do online disc and music file identification and obtain music-related information, including name, artist, track, and title information ("Gracenote Data") from online servers ("Gracenote Servers"), and to perform other functions. You may use Gracenote Data only by means of the intended End User functions of this application software.

You acknowledge and agree that Creative does not make any representation, undertaking or warranty, either express, implied, or otherwise regarding the provision, continuity of provision and/or use of Gracenote Client, Gracenote Data or Gracenote Server or related materials. You specifically agree that Creative does not guarantee that you will be able to access Gracenote services throughout the term of this Agreement.

You further acknowledge and agree that Creative shall not be responsible or liable, directly or indirectly, for any damage or loss caused by or alleged to be caused by or in connection with the use of or inability to use Gracenote Client, Gracenote Data or Gracenote Server or related materials.  

You agree that you will use Gracenote Data, the Gracenote Client, and Gracenote Servers for your own personal non-commercial use only. You agree not to assign, copy, transfer or transmit the Gracenote Client or any Gracenote Data (except in a Tag associated with a music file) to any third party. YOU AGREE NOT TO USE OR EXPLOIT GRACENOTE DATA, THE GRACENOTE CLIENT, OR GRACENOTE SERVERS, EXCEPT AS EXPRESSLY PERMITTED HEREIN. 

You agree that your non-exclusive license to use the Gracenote Data, the Gracenote Client, and Gracenote Servers will terminate if you violate these restrictions. If your license terminates, you agree to cease any and all use of the Gracenote Data, the Gracenote Client, and Gracenote Servers. Gracenote reserves all rights in Gracenote Data, the Gracenote Client, and the Gracenote Servers, including all ownership rights. Under no circumstances will Gracenote become liable for any payment to you for any information that you provide, including music file information. You agree that Gracenote may enforce its rights under this agreement against you directly in its own name.

The Gracenote Service uses a unique identifier to track queries for statistical purposes. The purpose of a randomly assigned numeric identifier is to allow the Gracenote service to count queries without knowing anything about who you are. For more information, see the web page at www.gracenote.com for the Gracenote Privacy Policy for the relevant Gracenote Service.

The Gracenote Client and each item of Gracenote Data are licensed to you "AS IS." Gracenote makes no representations or warranties, express or implied, regarding the accuracy of any Gracenote Data from the Gracenote Servers. Gracenote reserves the right to delete data from the Gracenote Servers or to change data categories for any cause that Gracenote deems sufficient. No warranty is made that the Gracenote Client or Gracenote Servers are error-free or that the functioning of the Gracenote Client or Gracenote Servers will be uninterrupted. Gracenote is not obligated to provide you with any enhanced or additional data types that Gracenote may choose to provide in the future and is free to discontinue its online services at any time. GRACENOTE DISCLAIMS ALL WARRANTIES EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. Gracenote does not warrant the results that will be obtained by your use of the Gracenote Client or any Gracenote Server. IN NO CASE WILL GRACENOTE BE LIABLE FOR ANY CONSEQUENTIAL OR INCIDENTAL DAMAGES OR FOR ANY LOST PROFITS OR LOST REVENUES. 

12. TERMINATION
The license granted to you is effective until terminated. You may terminate it at any time by destroying the Software (including any portions or copies thereof) currently in your possession or control. The license will also terminate automatically without any notice from Creative if you fail to comply with any term or condition of this Agreement. You agree upon any such termination to destroy the Software (including any portions or copies thereof). Upon termination, Creative may also enforce any and all rights provided by law. The provisions of this Agreement that protect the proprietary rights of Creative will continue in force after termination.

13. NO WARRANTY
ANY USE BY YOU OF THE SOFTWARE IS AT YOUR OWN RISK. THE SOFTWARE IS PROVIDED FOR USE ONLY WITH CREATIVE'S HARDWARE AND RELATED SOFTWARE. THE SOFTWARE IS PROVIDED FOR USE "AS IS" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, CREATIVE DISCLAIMS ALL WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NONINFRINGEMENT. CREATIVE IS NOT OBLIGATED TO PROVIDE ANY UPDATES OR UPGRADES TO THE SOFTWARE.

No distributor, dealer or any other entity or person is authorized to expand or alter this warranty or any other provisions of this Agreement. Creative does not warrant that the functions contained in the Software will meet your requirements or that the operation of the Software will be uninterrupted or error-free or free from malicious code. For purposes of this paragraph, "malicious code" means any program code designed to contaminate other computer programs or computer data, consume computer resources, modify, destroy, record, or transmit data, or in some other fashion usurp the normal operation of the computer, computer system, or computer network, including viruses, Trojan horses, droppers, worms, logic bombs, and the like. 

Any representation, other than the warranties set forth in this Agreement, will not bind Creative. You assume full responsibility for the selection of the Software to achieve your intended results, and for the downloading, use and results obtained from the Software. You also assume the entire risk as it applies to the quality and performance of the Software. Should the Software prove defective, you (and not Creative, or its distributors or dealers) assume the entire cost of all necessary servicing, repair or correction.

Further, Creative shall not be liable for the accuracy of any information provided by Creative or third-party technical support personnel, or any damages caused, either directly or indirectly, by acts taken or omissions made by you as a result of such technical support. 

This warranty gives you specific legal rights, and you may also have other rights which vary from country/state to country/state. Some countries/states do not allow the exclusion of implied warranties, so the above exclusion may not apply to you. Creative disclaims all warranties of any kind if the Software was customized, repackaged or altered in any way by any third party other than Creative.
 
14. DISCLAIMER OF DAMAGES: LIMITATION OF LIABILITY (Section 14 shall not apply to Trial Software. Please refer to Clause C under "Additional Provisions for Trial Software".)
IN NO EVENT SHALL CREATIVE OR ITS LICENSORS BE LIABLE FOR ANY DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, INCIDENTAL, INDIRECT, SPECIAL OR CONSEQUENTIAL DAMAGES, OR FOR ANY PERSONAL INJURY OR BODILY INJURY (INCLUDING DEATH) TO ANY PERSON CAUSED BY CREATIVE'S NEGLIGENCE, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OR INABILITY TO USE THIS SOFTWARE, EVEN IF CREATIVE OR ITS LICENSORS  HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE. IN NO EVENT WILL CREATIVE’S LIABILITY OR DAMAGES TO YOU OR ANY OTHER PERSON EVER EXCEED THE AMOUNT PAID BY YOU TO USE THE SOFTWARE, REGARDLESS OF THE FORM OF THE CLAIM. BECAUSE SOME STATES/ COUNTRIES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU.

15. INDEMNIFICATION BY YOU
If you distribute the Software in violation of this Agreement, you hereby indemnify, hold harmless and defend Creative from and against any and all claims or lawsuits, including attorney's fees and costs that arise, result from or are connected with the use or distribution of the Software in violation of this Agreement.

16. U.S. GOVERNMENT RESTRICTED RIGHTS
All Software and related documentation are provided with restricted rights. Use, duplication or disclosure by the U.S. Government is subject to restrictions as set forth in subdivision (b)(3)(ii) of the Rights in Technical Data and Computer Software Clause at 252.227-7013. If you are sub-licensing or using the Software outside of the United States, you will comply with the applicable local laws of your country, U.S. export control law, and the English version of this Agreement.

18. GENERAL
This Agreement is binding on you as well as your employees, employers, contractors and agents, and on any successors and assignees. Neither the Software nor any information derived therefrom may be exported except in accordance with the laws of the U.S. or other applicable provisions. This Agreement is governed by the laws of the State of California (except to the extent federal law governs copyrights and federally registered trademarks). This Agreement is the entire agreement between us and you agree that Creative will not have any liability for untrue statement or representation made by it, its agents or anyone else (whether innocently or negligently) upon which you relied upon entering this Agreement, unless such untrue statement or representation was made fraudulently. This Agreement supersedes any other understandings or agreements, including, but not limited to, advertising, with respect to the Software.

If any provision of this Agreement is deemed invalid or unenforceable by any country or government agency having jurisdiction, that particular provision will be deemed modified to the extent necessary to make the provision valid and enforceable, and the remaining provisions will remain in full force and effect.

This package may include software with DVD-Audio functionality for you to play content-protected DVD-Audio discs. The functionality of this Software may be lost if the content protection system is compromised. In this event, your sole remedy to restore such functionality is to download a product update from Creative's website.

ADDENDUM TO THE MICROSOFT SOFTWARE LICENSE AGREEMENT

IMPORTANT: By using the Microsoft software files (the "Microsoft Software") provided with this Addendum, you are agreeing to be bound by the following terms. If you do not agree to be bound by these terms, you may not use the Microsoft Software.

The Microsoft Software is provided for the sole purpose of replacing the corresponding files provided with a previously licensed copy of the Microsoft software product ("ORIGINAL PRODUCT"). Upon installation, the Microsoft Software files become part of the ORIGINAL PRODUCT and are subject to the same warranty and license terms and conditions as the ORIGINAL PRODUCT. If you do not have a valid license to use the ORIGINAL PRODUCT, you may not use the Microsoft Software. Any other use of the Microsoft Software is prohibited.

Nothing in this Agreement shall be construed on the part of Creative as advocating or authorizing the infringement of local and/or international laws applicable to your jurisdiction.

DRM ADDENDUM 
===============
The following addendum is applicable to products containing Windows Media digital rights management technology (WMDRM).

Content owners use Windows Media digital rights management technology (WMDRM) to protect their intellectual property, including copyrights. This device uses WMDRM software to access WMDRM-protected content. If the WMDRM software fails to protect the content, content owners may ask Microsoft to revoke the software’s ability to use WMDRM to play or copy protected content. Revocation does not affect unprotected content. When you download licenses for protected content, you agree that Microsoft may include a revocation list with the licenses. Content owners may require you to upgrade WMDRM to access their content. If you decline an upgrade, you will not be able to access content that requires the upgrade. 

COPYRIGHT INFORMATION FOR USERS OF CREATIVE PRODUCTS

Unless you own the copyright or have such authorization, you may be violating copyright law and may be subject to payment of damages and other remedies. If you are uncertain about your rights, you should contact your legal advisor. 

It is your responsibility when using a Creative product to ensure there is no infringement of applicable laws on copyright whereby the copying of certain materials may require the prior consent of the copyright owners. Creative disclaims any liability with regard to any illegal use of the Creative product and Creative shall in no event be liable with regard to the origin of any data stored in a compressed audio file. 

You acknowledge and agree that the exportation or use of MP3 Codecs that may be included with your software, in real-time broadcasting (terrestrial, satellite, cable or other media) or broadcasting via Internet or other networks, such as but not limited to intranets etc., in pay-audio or pay-on-demand applications, is not authorized and/or licensed.

SPECIAL PROVISIONS APPLICABLE TO THE EUROPEAN UNION

If you downloaded the Software in the European Union (EU), the following provisions also apply to you. If there is any inconsistency between the terms of the Software License Agreement set out above and the following provisions, the following provisions shall take PRECEDENCE.

Decompilation:
You agree not for any purpose to transmit the Software or display the Software's object code on any computer screen or to make any hard copy memory dumps of the Software's object code. If you believe you require information related to the interoperability of the Software with other programs, you shall not decompile or disassemble the Software to obtain such information, and you agree to request such information from Creative at the address listed earlier. Upon receiving such a request, Creative shall determine whether you require such information for a legitimate purpose and, if so, Creative will provide such information to you within a reasonable time and on reasonable conditions.

LIMITED WARRANTY:
EXCEPT AS STATED ABOVE IN THIS AGREEMENT, AND AS PROVIDED BELOW UNDER THE HEADING "STATUTORY RIGHTS", THE SOFTWARE IS PROVIDED AS-IS WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, QUALITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NONINFRINGEMENT.

LIMITATION OF REMEDY AND DAMAGES:
THE LIMITATIONS OF REMEDIES AND DAMAGES IN THE SOFTWARE LICENSE AGREEMENT SHALL NOT APPLY TO PERSONAL INJURY (INCLUDING DEATH) TO ANY PERSON CAUSED BY CREATIVE'S NEGLIGENCE AND ARE SUBJECT TO THE PROVISION SET OUT BELOW UNDER THE HEADING "STATUTORY RIGHTS".

Statutory rights:
Irish law provides that certain conditions and warranties may be implied in contracts for the sale of goods and in contracts for the supply of services. Such conditions and warranties are hereby excluded, to the extent such exclusion, in the context of this transaction, is lawful under Irish law. Conversely, such conditions and warranties, insofar as they may not be lawfully excluded, shall apply. Accordingly nothing in this Agreement shall prejudice any rights that you may enjoy by virtue of Sections 12, 13, 14 or 15 of the Irish Sale of Goods Act 1893 (as amended).

General:
This Agreement is governed by the laws of the Republic of Ireland. The local language version of this Agreement shall apply to Software downloaded in the EU. This Agreement is the entire agreement between us, and you agree that Creative will not have any liability for any untrue statement or representation made by it, its agents or anyone else (whether innocently or negligently) upon which you relied upon entering this Agreement, unless such untrue statement or representation was made fraudulently.

ADDITIONAL PROVISIONS FOR TRIAL SOFTWARE

A. Installation and Use Rights
You may install the Trial Software only once per device (solely in object code form). You are authorised to use the Trial Software only on one device at any given time (maximum number of 3 devices but only one device at any given time). Simultaneous use of the Trial Software on more than one device is not permitted under this License. You may use the Trial Software only to internally evaluate it for your personal purposes. You are not granted any rights to use the Trial Software for any commercial purposes or derive profit in any manner whatsoever.

B. Trial Period
The Trial Software has an in-built tracker which allows the Trial Software to be activated for the period of time specified on the web download page while installing the Trial Software (including the date of installation - "Trial Period"). At the end of the Trial Period, if you choose not to purchase the Software, the Trial Software will be deactivated and you are not authorised to use the Trial Software after the Trial Period. You may not receive any notice warning that the Trial Software is going to be deactivated or expire at the end of the Trial Period. If you decide not to purchase the Trial Software, you must uninstall the Trial Software from your device, otherwise it will reside in your device even after deactivation. You may not be able to access data used with the Trial Software after it has been deactivated. Neither Creative nor its affiliates will be, in any manner responsible for any loss of data or information or any other discrepancy resulting from the deactivation of the Trial Software.

C. DISCLAIMER OF DAMAGES: LIMITATION OF LIABILITY 
IN NO EVENT SHALL CREATIVE OR ITS LICENSORS BE LIABLE FOR ANY DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, INCIDENTAL, INDIRECT, SPECIAL OR CONSEQUENTIAL DAMAGES, OR FOR ANY PERSONAL INJURY OR BODILY INJURY (INCLUDING DEATH) TO ANY PERSON CAUSED BY CREATIVE'S NEGLIGENCE, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR OTHER PECUNIARY LOSS) ARISING OUT OF THIS AGREEMENT OR THE USE OR INABILITY TO USE THIS TRIAL SOFTWARE, EVEN IF CREATIVE OR ITS
 LICENSORS HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. BECAUSE SOME STATES/ COUNTRIES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR DEATH, PERSONAL OR BODILY INJURY, CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU.

How To Update Drivers Manually

After your driver has been downloaded, follow these simple steps to install it.

  • Expand the archive file (if the download file is in zip or rar format).

  • If the expanded file has an .exe extension, double click it and follow the installation instructions.

  • Otherwise, open Device Manager by right-clicking the Start menu and selecting Device Manager.

  • Find the device and model you want to update in the device list.

  • Double-click on it to open the Properties dialog box.

  • From the Properties dialog box, select the Driver tab.

  • Click the Update Driver button, then follow the instructions.

Very important: You must reboot your system to ensure that any driver updates have taken effect.
