TERMS OF USE


ACCEPTANCE OF TERMS.
The Services that Microsoft provides to you are subject to this terms of use agreement ("TOU"). Microsoft reserves the right to change the TOU, including but not limited to any charges associated with the use of the Services. You are responsible for regularly reviewing the TOU. Microsoft may change or terminate the TOU or any part of it without notice or liability to Microsoft. Your continued use of the Services constitutes your agreement to the TOU. 

DESCRIPTION OF SERVICES.
Microsoft may provide you with access to error reporting data and information (¡°Data¡±) gathered by Microsoft from Microsoft customers using Microsoft products, along with certain associated content and/or software (collectively "Services"). The Services and your use of the Data, including any updates, enhancements, or new features to either of the foregoing, and/or the addition of any new Web properties to the Services, are subject to the TOU. 

USE AND LIMITATIONS.
You, or if an entity, your employees, may access the Services and use the Services and Data internally, solely to test and resolve compatibility issues related to the use of your products with Microsoft products and to provide feedback thereon to Microsoft (the ¡°Purpose¡±). You must store any Data only on a secure server with limited access for a maximum of six (6) months. Access to such server will be limited to you or, if an entity, your regular employees. Following such six (6) month period, you will promptly destroy the Data. You may not reverse engineer, decompile or disassemble the Services, except and only to the extent that such activity is expressly permitted by applicable law notwithstanding this limitation. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, offer to sell or sell the Data or any other information, software, products or services obtained from the Services, except that you may internally use the Services and internally use and copy the Data, all solely for the Purpose. It is acknowledged that you may modify your affected products in order to resolve compatibility issues related to the use of your products with Microsoft products. In addition, you will not use the Data or the Services for any purpose not expressly granted by Microsoft in this TOU, including, without limitation, promotional, sales, advertising, competitive analysis, or marketing purposes. 

PROTECTION OF PERSONAL INFORMATION.
The Data may include Personal Information. For the purposes of this TOU, "Personal Information" means any information provided by Microsoft or received by you in connection with this TOU: (i) that identifies or can be used to identify, contact, or locate the person to whom such information pertains; or (ii) from which identification or contact information of an individual person can be derived. Personal Information includes, but is not limited to: name, address, phone number, fax number, email address, social security number or other government-issued identifier, and credit card information. Additionally, to the extent any other information (such as, but not necessarily limited to, a personal profile, unique identifier, biometric information, and/or IP address) is associated or combined with Personal Information, then such information will also be considered Personal Information. You may incidentally access Personal Information within the Data while you are using the Services only as expressly allowed by this TOU. You are not entitled to use such Personal Information for any purpose and you must destroy the Personal Information in conjunction with your destruction of the Data as required under this TOU. You will not use Personal Information to contact any individual. You will maintain such Personal Information in strict confidence. You will not share any Personal Information that is collected or possessed by you with any third party for any reason. If you are served with a court order compelling disclosure of any Personal Information, you will oppose the order, will notify Microsoft of such order, and will provide Microsoft the opportunity to intervene before you file any response to the order. You will take reasonable steps to protect Personal Information in your possession from unauthorized use, access, disclosure, alteration or destruction. Security measures shall include access controls, encryption or other means, where appropriate. You agree to conduct an audit on at least an annual basis to evaluate the security of Personal Information in your possession and to verify that the terms of this TOU with respect to Personal Information are being followed. Upon request from Microsoft, you shall provide Microsoft with any or all Personal Information in your possession. Upon termination or expiration of this Agreement, you shall within ten (10) days thereafter, at Microsoft's sole discretion either (i) provide Microsoft with all documents and materials (including any and all copies) containing Personal Information, together with all other materials and property of Microsoft, which are in your possession or under your control or (ii) destroy all such specified documents and materials (including any and all copies in any and all formats) and provide Microsoft with a certificate of destruction signed by you, or if an entity, by an officer of your company. 

OWNERSHIP.
Microsoft and its customers retain all right, title, and interest in and to the Services and any Data provided to you as part of the Services. You agree that you acquire no interest in the Services or in any Data you may receive as part of the Services, through your use of such Services. 

CONTENT AND SOFTWARE AVAILABLE THROUGH THE SERVICE. All content and software (if any) that is made available to view and/or download in connection with the Services ("Software") is owned by and is the copyrighted work of Microsoft Corporation, its suppliers, and/or its customers, and is protected by copyright laws and international treaty provisions. Your use of the Software is governed by the terms of the end user license agreement, if any, which accompanies or is included with the Software ("License Agreement"). You may not install or use any Software that is accompanied by or includes a License Agreement unless you first agree to the License Agreement terms. Microsoft reserves all rights not expressly granted herein. For any Software not accompanied by a license agreement, Microsoft Corporation hereby grants to you, a revocable personal, non-transferable license to use the Software for viewing and otherwise using the Services in accordance with the terms of this TOU, and for no other purpose, provided that you keep intact all copyright and other proprietary notices. You acknowledge that the Software, and any accompanying documentation and/or technical information, is subject to applicable export control laws and regulations of the USA. You agree not to export or re-export the Software, directly or indirectly, to any countries that are subject to USA export restrictions. 

LIABILITY DISCLAIMER.
THE DATA, SOFTWARE, PRODUCTS, AND SERVICES INCLUDED IN OR AVAILABLE THROUGH THE SERVICES MAY INCLUDE INACCURACIES OR TYPOGRAPHICAL ERRORS. CHANGES ARE PERIODICALLY MADE TO THE SERVICES AND TO THE INFORMATION THEREIN. MICROSOFT AND/OR ITS RESPECTIVE SUPPLIERS MAY MAKE IMPROVEMENTS AND/OR CHANGES IN THE SERVICES AT ANY TIME. MICROSOFT AND/OR ITS RESPECTIVE SUPPLIERS MAKE NO REPRESENTATIONS ABOUT THE SUITABILITY, RELIABILITY, AVAILABILITY, TIMELINESS, LACK OF VIRUSES OR OTHER HARMFUL COMPONENTS AND ACCURACY OF THE DATA, SOFTWARE, PRODUCTS OR SERVICES FOR ANY PURPOSE. ALL DATA, SOFTWARE, PRODUCTS AND SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, STATUTORY, OR IMPLIED. MICROSOFT AND/OR ITS RESPECTIVE SUPPLIERS HEREBY DISCLAIM ALL WARRANTIES AND CONDITIONS WITH REGARD TO THE DATA, SOFTWARE, PRODUCTS AND SERVICES, INCLUDING ALL IMPLIED WARRANTIES AND CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, WORKMANLIKE EFFORT, TITLE AND NON-INFRINGEMENT. YOU SPECIFICALLY AGREE THAT MICROSOFT SHALL NOT BE RESPONSIBLE FOR UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA AS A RESULT OF YOUR USE OF THE SERVICES, ANY MATERIAL OR DATA SENT OR RECEIVED OR NOT SENT OR RECEIVED AS A RESULT OF YOUR USE OF THE SERVICES, OR ANY TRANSACTIONS ENTERED INTO THROUGH THE SERVICES. IN NO EVENT SHALL MICROSOFT AND/OR ITS SUPPLIERS BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL DAMAGES OR ANY DAMAGES WHATSOEVER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF USE, DATA OR PROFITS, ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OR PERFORMANCE OF THE SERVICES, WITH THE DELAY OR INABILITY TO USE THE SERVICES OR RELATED SERVICES, THE PROVISION OF OR FAILURE TO PROVIDE SERVICES, OR FOR ANY DATA, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS OBTAINED THROUGH THE SERVICES, OR OTHERWISE ARISING OUT OF THE USE OF THE SERVICES, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY OR OTHERWISE, EVEN IF MICROSOFT OR ANY OF ITS SUPPLIERS HAS BEEN ADVISED OF THE POSSIBILITY OF DAMAGES. BECAUSE SOME STATES/JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU. IF YOU ARE DISSATISFIED WITH ANY PORTION OF THE SERVICES, OR WITH ANY PART OF THIS TOU, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING THE SERVICES. 

MEMBER ACCOUNT, PASSWORD, AND SECURITY.
If any of the Services requires you to open an account, you must complete the registration process by providing us with current, complete and accurate information as prompted by the applicable registration form. You also will choose a password and a user name. You are entirely responsible for maintaining the confidentiality of your password and account. Furthermore, you are entirely responsible for any and all activities that occur under your account. You agree to notify Microsoft immediately of any unauthorized use of your account or any other breach of security. Microsoft will not be liable for any loss that you may incur as a result of someone else using your password or account, either with or without your knowledge. However, you could be held liable for losses incurred by Microsoft or another party due to someone else using your account or password. You may not use anyone else's account at any time, without the permission of the account holder. 

NO UNLAWFUL OR PROHIBITED USE.
As a condition of your use of the Services, you will not use the Services (including without limitation the Data or the Software) for any purpose that is unlawful or prohibited by this TOU. You may not use the Services in any manner that could damage, disable, overburden, or impair any Microsoft server, or the network(s) connected to any Microsoft server, or interfere with any other party's use and enjoyment of any Services. You may not attempt to gain unauthorized access to any Services, other accounts, computer systems or networks connected to any Microsoft server or to any of the Services, through hacking, password mining or any other means. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available through the Services. 

FEEDBACK PROVIDED TO MICROSOFT.
Microsoft does not claim ownership of any comments, suggestions, or feedback you may provide to Microsoft in connection with the Services ("Feedback"). However, by providing Feedback to Microsoft, you are granting Microsoft, its affiliated companies and necessary sublicensees, a worldwide, royalty-free right and license to use, copy, modify, distribute, transmit, publicly display, publicly perform, reproduce, edit, translate, reformat, license, offer to sell, and sell, rent, lease, or lend your Feedback, entirely without obligation or restriction of any kind on account of intellectual property rights or otherwise; and the right to sublicense such rights to any third party. Feedback, even if designated as confidential by you, shall not, absent a separate written agreement, create any confidentiality obligation for or upon Microsoft. You will not give Feedback that is subject to license terms that seek to require any Microsoft product, technology, service or documentation incorporating or derived from such Feedback, or any Microsoft intellectual property, to be licensed or otherwise shared with any third party. No compensation will be paid with respect to the use of your Feedback, as provided herein. Microsoft is under no obligation to use any Feedback you may provide. By providing Feedback you warrant and represent that you own or otherwise control all of the rights to your Feedback as described in this TOU including, without limitation, all the rights necessary for you to license the Feedback to Microsoft under the terms set forth above.

GENERAL. This TOU is governed by the laws of the State of Washington, U.S.A. You hereby consent to the exclusive jurisdiction and venue of courts in King County, Washington, U.S.A. in all disputes arising out of or relating to the use of the Service. You agree to waive all defenses of lack of personal jurisdiction and forum non conveniens. Process may be served on either party in the manner authorized by applicable law or court rule. If either party employs attorneys to enforce any rights arising out of or relating to this TOU, the prevailing party shall be entitled to recover its reasonable attorneys' fees, costs and other expenses. You agree that no joint venture, partnership, employment, or agency relationship exists between you and Microsoft as a result of this TOU or use of the Services. If any part of this TOU is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of this TOU shall continue in effect. Unless otherwise specified herein, this TOU constitutes the entire agreement between the user and Microsoft with respect to the Services and supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between you and Microsoft with respect to the Services. Microsoft reserves all rights not expressly granted herein.

How To Update Drivers Manually

After your driver has been downloaded, follow these simple steps to install it.

  • Expand the archive file (if the download file is in zip or rar format).

  • If the expanded file has an .exe extension, double click it and follow the installation instructions.

  • Otherwise, open Device Manager by right-clicking the Start menu and selecting Device Manager.

  • Find the device and model you want to update in the device list.

  • Double-click on it to open the Properties dialog box.

  • From the Properties dialog box, select the Driver tab.

  • Click the Update Driver button, then follow the instructions.

Very important: You must reboot your system to ensure that any driver updates have taken effect.
