End User License Agreement & Warranty Information

The following is a legal software license agreement between you, the software end user, and manufacturer.  Carefully read the following agreement before installing the product.  Using the product indicates that you have read and agree to license terms and conditions herein. Manufacturer independently publishes this software. Information is subject to change without notice and does not represent a commitment on the part of manufacturer. 

Copyright Information

Manufacturer and all manufacturer product names are trademarks of manufacturer. The manufacturer logo is a registered trademark of manufacturer.

Software contained in this package is owned by manufacturer and is protected by United States copyright laws, international treaty provisions, and all other applicable national laws. The software must be treated like all other copyrighted materials (e.g. books and musical recordings), with two exceptions: (a) one copy of the software can be made for backup purposes; (b) the program may be transferred to a single hard disk, provided the original copy is used only as a backup.  This license does not allow the software to be rented or leased without the prior written consent of manufacturer.

Video, Music, and Photographic content contained within the manufacturer software are for individual and/or personal use only. Content may not be used in any professional manner, re-licensed, resold, sold, rented, or leased. Content may not be used in conjunction with any other media designed to be licensed, resold, rented, or leased.  Music content contained within the software has been provided with the expressed written consent of Geoffrey Wilson and may not be broadcast without prior permission.

Restricted Rights Legend
Use, duplication, or disclosure is subject to restrictions as set forth in contract subdivision (c)(1)(ii) of the Rights in Technical Data and Computer Software Clause 52.227-FAR14. Material scanned by this product may be protected by governmental laws and other regulations, such as copyright laws. The customer is solely responsible for complying with all such laws and regulations. If this product was purchased in the United States, this Agreement is governed by the laws of the state of California; otherwise, local laws may apply.

Manufacturer Statement of Limited Warranty
 
Manufacturer warrants this product to be free from defects in material and workmanship for a period of (1) or (2) years from the date of original purchase, depending on the specific product purchased (consult your product user guide for details). If this product proves to be defective in material or workmanship during the warranty period as defined in the product user guide, manufacturer will, at its sole option, repair or replace the product with a similar product. Replacement product or parts may include remanufactured or refurbished parts or components.

Who the warranty protects: 

This warranty is valid for the original consumer purchaser only.

What the warranty does not cover: 

1. Any manufacturer product on which the serial number has been defaced, modified or removed.

2. Damage, deterioration or malfunction resulting from: 
Accident, misuse, neglect, fire, water, lightning, or other acts of nature, unauthorized product modification, or failure to follow instructions supplied with the product. Repair or attempted repair by anyone not authorized by manufacturer. Any damage of the product due to shipment. Removal or installation of the product. Causes external to the product, such as electric power fluctuations or failure. Use of supplies or parts not meeting manufacturer specifications. Normal wear and tear. Any other cause which does not relate to a product defect.
 
3. Removal, installation and set-up service charges by any third party.

4. Costs associated with shipping and/or transporting the product for repair, replacement, or exchange.

How to get service:

1. To obtain warranty service, you will be required to provide: 
A copy of the original dated sales slip or sales invoice 
Your name
Your address 
The serial number of the product 
A description of the problem

2. A technical support representative will determine if your problem is covered under this warranty agreement. If the problem is covered, you will be issued a Return Merchandise Authorization number (RMA) with specific instructions regarding how the product must be returned to manufacturer for repair or replacement.  

Limitation of implied warranties:

THERE ARE NO WARRANTIES, EXPRESS OR IMPLIED, WHICH EXTEND BEYOND THE DESCRIPTION CONTAINED HEREIN INCLUDING THE IMPLIED WARRANTY OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

Exclusion of damages:

MANUFACTURER'S LIABILITY IS LIMITED TO THE COST OF REPAIR OR REPLACEMENT OF THE PRODUCT. MANUFACTURER SHALL NOT BE LIABLE FOR:

1. DAMAGE TO OTHER PROPERTY CAUSED BY ANY DEFECTS IN THE PRODUCT, DAMAGES BASED UPON INCONVENIENCE, LOSS OF USE OF THE PRODUCT, LOSS OF TIME, LOSS OF PROFITS, LOSS OF BUSINESS OPPORTUNITY, LOSS OF GOODWILL, INTERFERENCE WITH BUSINESS RELATIONSHIPS, OR OTHER COMMERCIAL LOSS, EVEN IF ADVISED OF THEIR POSSIBILITY OF SUCH DAMAGES.

2. ANY OTHER DAMAGES, WHETHER INCIDENTAL, CONSEQUENTIAL OR OTHERWISE.

3. ANY CLAIM AGAINST THE CUSTOMER BY ANY OTHER PARTY.

Effect of local law:

This warranty gives you specific legal rights, and you may also have other rights which vary from locality to locality. Some localities do not allow limitations on implied warranties and/or do not allow the exclusion of incidental or consequential damages, so the above limitations and exclusions may not apply to you.


FCC Radio Frequency Interference Statement 
Note: This equipment has been tested and found to comply with the limits for a Class B Creative device, pursuant to Part 15 of FCC rules. These limits are designed to provide reasonable protection against harmful interference in a residential installation. This equipment generates, uses, and can radiate radio frequency energy and, if not installed and used in accordance with the instruction guide, may cause harmful interference to radio communications. However, there is no guarantee that interference will not occur in a particular installation. How To Update Drivers Manually

After your driver has been downloaded, follow these simple steps to install it.

  • Expand the archive file (if the download file is in zip or rar format).

  • If the expanded file has an .exe extension, double click it and follow the installation instructions.

  • Otherwise, open Device Manager by right-clicking the Start menu and selecting Device Manager.

  • Find the device and model you want to update in the device list.

  • Double-click on it to open the Properties dialog box.

  • From the Properties dialog box, select the Driver tab.

  • Click the Update Driver button, then follow the instructions.

Very important: You must reboot your system to ensure that any driver updates have taken effect.
