END-USER LICENSE AGREEMENT

Definition:

This is a legal agreement between you and Panasonic Communications Co., Ltd. (hereinafter called "Panasonic") for use of the Licensed Software.  It needs your acceptance to this agreement to use the Licensed Software.  Please carefully read this agreement before using Licensed Software.  Your use of Licensed Software shall be conclusively deemed to constitute your acceptance of the terms of this agreement.  If you do not agree this agreement, do not use, download or install Licensed Software.

1. COPYRIGHT
Panasonic and/or its licenser have all title and right of Licensed Software.  Panasonic has the right to license or has been granted the right to license the Licensed Software.  You acknowledge that you are receiving only a personal, non-transferable and non-exclusive LIMITED LICENSE TO USE the Licensed Software and related documentation, if any, in accordance with the following terms and conditions, and that you shall obtain no title, ownership nor any other rights in or to the Licensed Software and related documentation nor in or to the algorithms, concepts, designs and ideas represented by or incorporated in the Licensed Software and related documentation, all of which title and rights shall remain with Panasonic and its licenser.

2. LICENSE
(1) You have the non-exclusive rights to use the Licensed Software on your computer(s) provided that the number of your computer(s) shall be within the Permitted Number.  If you are corporation, you can use the Licensed Software in your corporation and in one site within the Permitted Number of computer(s).
(2) If the above Server Use column is "Acceptable", you may install the Licensed Software into a network server and/or its clients and use the copies of Licensed Software in your network provided the number of your computer(s) using the Licensed Software simultaneously should be within the Permitted Number.  If the above Server Use column is "Not Acceptable", you cannot install the Licensed Software into a network server and/or its clients and use the copies of Licensed Software in your network.
(3) If the Licensed Software is software for Panasonic hardware product (hereinafter called "Product Software".  It includes update version.), you may use the Licensed Software on computer that said Panasonic hardware product is connected with (including a connection by network).

3. RESTRICTION
(1) Before you start using the Licensed Software, you shall make back-up copies of valuable files in storage apparatus, such as floppy disk or hard disk connected with your computer. 
(2) You may not make copies of the Licensed Software and related documentation, provided you may make reasonable quantities of copies of the Licensed Software solely for backup or archival purposes.
(3) You may not modify, alter or transfer the Licensed Software.
(4) You may not reverse engineer, decompile or disassemble the Licensed Software, except that in European Union and European Free Trade Association, you may have the limited right to reverse engineer, decompile or disassemble the Licensed Software solely to the extent specifically permitted by the terms and conditions of Article 6 of the European Community's Directive for the Legal Protection of Computer Programs, OJL 122/42 (17 May 1991).
(5) You may not rent or lease the Licensed Software whether with or without charge.

4. LIMITED WARRANTY
The Licensed Software is being delivered to you "AS IS".  NEITHER PANASONIC (including Matsushita Electric Industrial Co., Ltd. in this Article) NOR ITS LICENSER MAKES OR PASSES ON TO YOU OR OTHER THIRD PARTY, ANY WARRANTY OR REPRESENTATION INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTY OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.  WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, NEITHER PANASONIC NOR ITS LICENSER WARRANTS THAT THE SOFTWARE WILL BE ERROR-FREE OR THAT IT WILL MEET YOUR REQUIREMENTS.  NEITHER PANASONIC NOR ITS LICENSER SHALL BE LIABLE FOR ANY DAMAGE SUFFERED BY YOU INCLUDING, BUT NOT LIMITED TO, CONSEQUENTIAL, INCIDENTAL SPECIAL OR PUNITIVE DAMAGES.  THE ABOVE LIMITATIONS SHALL APPLY REGARDLESS OF THE FORM OF ACTION WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT PRODUCT LIABILITY OR OTHERWISE, EVEN IF SUCH PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.  Panasonic shall not be responsible to modify the Licensed Software to adapt to your computer system as it is or when you change an environment, such as operating system or its version-up.

5. U.S. GOVERNMENT RESTRICTED RIGHTS LEGEND
This Licensed Software and the related documentation are provided with "RESTRICTED RIGHTS" applicable to private and public licenses alike.  Without limiting the foregoing, use, duplication, or disclosure by the US Government is subject to restrictions as set forth in this Agreement and as provided in DFARS 227.7202-1(a) and 227.7202-3(a) (1995), DFARS 252.227-7013 (c)(1)(ii)(OCT 1988), FAR 12.212(a)(1995), FAR 52.227-19, or FAR 52.227-14, as applicable. 6. ASSIGNMENT
You may transfer your right under this Agreement on a permanent basis, provided that you transfer this Agreement, all copies of the Licensed Software, all related documentation and all accompanied Panasonic hardware product (in case of Product Software), and the recipient thereof agrees the terms of this Agreement.

7. TERM
This license is effective until terminated.  You may terminate this Agreement at any time by destroying the Licensed Software and related documentation and all copies thereof.  This license will also terminate if you fail to comply with any term or condition of this Agreement.  Upon such termination, you agree to destroy the Licensed Software and related documentation and all copies thereof.

8. SEVERABILITY
Nothing contained in this Agreement shall be construed so as to require the commission of any act contrary to statute or law, and whenever there is any conflict between any provisions of this Agreement and any statute or law, contrary to which the parties have no legal right to contract, the latter shall prevail.  In such event, however, the provisions of this Agreement affected shall be curtailed and limited only to the extent necessary to bring it within the legal requirements.

ELECTRONIC END USER LICENSE AGREEMENT


NOTICE TO USER:
THIS IS A CONTRACT.  BY INDICATING YOUR ACCEPTANCE BELOW, YOU ACCEPT ALL THE TERMS AND CONDITIONS OF THIS AGREEMENT INCLUDING IN PARTICULAR THE LIMITATIONS ON: USE CONTAINED IN SECTIONS 2 AND 4; AND WARRANTY AND LIABILITY IN SECTION 5.  YOU AGREE THAT THIS AGREEMENT IS ENFORCEABLE LIKE ANY WRITTEN NEGOTIATED AGREEMENT SIGNED BY YOU.

This End User License Agreement accompanies the PostScript® driver software product, other software and related explanatory materials collectively the ("Software"). 

Upon your acceptance of this Agreement, Adobe grants to you a nonexclusive license to use the Software, provided that you agree to the following:

1.  Definitions. "Adobe" means Adobe Systems Incorporated, a Delaware corporation, 345 Park Avenue, San Jose, California 95110, if subsection 6(a) of this Agreement applies; otherwise it means Adobe Systems Benelux BV, Europlaza, Hoogoorddreef 54a, 1101 BE Amsterdam ZO, the Netherlands, a company organized under the laws of the Netherlands and an affiliate and licensee of Adobe Systems Incorporated. 

2.  Use of the Software. You may install and use (i) the Postscript driver software product on any number of printers containing PostScript software from Adobe and an unlimited number of CPUs, or (ii) the Software in conjunction with the corresponding application software from Adobe with which this Software is bundled, regardless of which type of printer you are using.  

3.  Copyright and Trademark Rights.  The Software, and any copies you are authorized by Adobe to make, are owned by Adobe and its suppliers, and its structure, organization and code are the valuable trade secrets and confidential information of Adobe and its suppliers.  The Software also is protected by copyright, including without limitation by United States Copyright Law, international treaty provisions, and applicable laws in the country in which it is being used. Except as expressly stated above, this Agreement does not grant you any intellectual property rights in the Software.

4.  Restrictions. You agree not to modify, adapt, translate, reverse engineer, decompile, disassemble or otherwise attempt to discover the source code of the Software, except to the extent (a) you may be expressly permitted to decompile under applicable law, (b) it is essential to do so in order to achieve operability of the Software with another software program, and (c) you have first requested that Adobe provide the information necessary to achieve such operability and Adobe has not made such information available.  Adobe has the right to impose reasonable conditions and to request a reasonable fee before providing such information.  Any information supplied by Adobe or obtained by you,
as permitted hereunder, may only be used by you for the purpose described herein and may not be disclosed to any third party or used to create any software which is substantially similar to the expression of the Software. Requests for information should be directed to the appropriate Adobe Customer Support Department listed at http://www.adobe.com/support/phonenumbers/main.html. 

5.  NO WARRANTY.  The Software is being delivered to you "AS IS" and Adobe makes no warranty as to its use or performance.  ADOBE AND ITS SUPPLIERS DO NOT AND CANNOT WARRANT THE PERFORMANCE OR RESULTS YOU MAY OBTAIN BY USING THE SOFTWARE OR DOCUMENTATION.  EXCEPT FOR ANY WARRANTY, CONDITION, REPRESENTATION OR TERM TO THE EXTENT TO WHICH THE SAME CANNOT OR MAY NOT BE EXCLUDED OR LIMITED BY LAW APPLICABLE TO YOU IN YOUR JURISDICTION, ADOBE AND ITS SUPPLIERS MAKE NO WARRANTIES CONDITIONS, REPRESENTATIONS, OR TERMS, (EXPRESS OR IMPLIED WHETHER BY STATUTE, COMMON LAW, CUSTOM, USAGE OR OTHERWISE, AS TO ANY MATTER INCLUDING WITHOUT LIMITATION NONINFRINGEMENT OF THIRD PARTY RIGHTS, MERCHANTABILITY, INTEGRATION, SATISFACTORY QUALITY, OR FITNESS FOR ANY PARTICULAR PURPOSE).  IN NO EVENT WILL ADOBE OR ITS SUPPLIERS BE LIABLE TO YOU FOR ANY DAMAGES, CLAIMS, COSTS WHATSOEVER OR ANY CONSEQUENTIAL, INDIRECT, INCIDENTAL, PUNITIVE OR SPECIAL DAMAGES, OR ANY LOST PROFITS OR LOST SAVINGS, EVEN IF AN ADOBE REPRESENTATIVE HAS
BEEN ADVISED OF THE POSSIBILITY OF SUCH LOSS, DAMAGES, CLAIMS OR COSTS OR FOR ANY CLAIM BY ANY THIRD PARTY.  The foregoing limitations and exclusions apply to the extent permitted by applicable law in your jurisdiction.  Nothing contained in this Agreement limits Adobe's liability to you in the event of death or personal injury resulting from Adobe's negligence or for the tort of deceit (fraud).  Adobe is acting on behalf of it's suppliers for the purpose of disclaiming, excluding and/or limiting obligations, warranties and liability as provided in this Agreement, but in no other respects and for no other purpose.

6. Governing Law and General Provisions.  This Agreement will be governed by and construed in accordance with the substantive laws in force: (a) in the State of California, if a license to the Software is acquired when you are in the United States, Canada, or Mexico; or (b) in Japan, if a license to the Software is acquired when you are in Japan, China, Korea, R.O.C, or other Southeast Asian country where all official languages are written in either an ideographic script (e.g., hanzi, kanji, or hanja), and/or other script based upon or similar in structure to an ideographic script, such as hangul or kana; or (c) the Netherlands, if a license to the Software is acquired when you are in any other jurisdiction not described above. The respective courts of Santa Clara County, California when California law applies, Tokyo District Court in Japan, when Japanese law applies, and the courts of Amsterdam, the Netherlands, when the law of the Netherlands applies,
shall each have non-exclusive jurisdiction over all disputes relating to this Agreement.This Agreement will not be governed by the conflict of law rules of any jurisdiction or the United Nations Convention on Contracts for the International Sale of Goods, the application of which is expressly excluded. 

7. Notice to U.S. Government End Users.  The Software and Documentation are "Commercial Items," as that term is defined at 48 C.F.R. §2.101, consisting of "Commercial Computer Software" and "Commercial Computer Software Documentation," as such terms are used in 48 C.F.R. §12.212 or 48 C.F.R. §227.7202,as applicable. Consistent with 48 C.F.R. §12.212 or 48 C.F.R. §§227.7202-1 through 227.7202-4, as applicable, the Commercial Computer Software and Commercial Computer Software Documentation are being licensed to U.S. Government end users (a) only as Commercial Items and (b) with only those rights as are granted to all other end users pursuant to the terms and conditions herein. How To Update Drivers Manually

After your driver has been downloaded, follow these simple steps to install it.

  • Expand the archive file (if the download file is in zip or rar format).

  • If the expanded file has an .exe extension, double click it and follow the installation instructions.

  • Otherwise, open Device Manager by right-clicking the Start menu and selecting Device Manager.

  • Find the device and model you want to update in the device list.

  • Double-click on it to open the Properties dialog box.

  • From the Properties dialog box, select the Driver tab.

  • Click the Update Driver button, then follow the instructions.

Very important: You must reboot your system to ensure that any driver updates have taken effect.
