A presente versão Português do Contrato de Licença de Utilização de Software é prestada apenas para fins informativos e, no caso de qualquer discordância no respeitante à tradução, a versão no idioma Inglês prevalece para fins de determinar a devida interpretação dos termos contidos no referido Contrato.  

CONTRATO DE LICENÇA DE UTILIZAÇÃO DE SOFTWARE DA INTEL (Utilizador Final, Único)

IMPORTANTE - LER CUIDADOSAMENTE ANTES DE COPIAR, INSTALAR OU UTILIZAR O SOFTWARE 
Não utilizar ou carregar este software, bem como quaisquer materiais a ele associados (colectivamente denominado por "Software") antes de ler cuidadosamente os termos e condições abaixo mencionados. Ao carregar ou utilizar o Software, o utilizador manifesta o seu acordo com os termos do presente Contrato. Contudo, caso o utilizador não concorde com tais termos, então não deverá instalar nem usar o Software. 

LICENÇA. O utilizador poderá copiar o Software para um computador único para seu uso pessoal e não comercial, podendo, ainda, fazer uma cópia reserva do Software com observância das seguintes condições:  
1.  O utilizador não poderá copiar, modificar, alugar, vender, distribuir ou transferir qualquer parte do Software, excepto nas condições previstas no presente Contrato, e acorda, ainda, em impedir a cópia não autorizada do Software. 
2.  O utilizador não poderá proceder a engenharia reversa, descompilar ou descodificar o Software. 
3.  O utilizador não poderá sublocar ou permitir a utilização simultânea do Software por mais do que um utilizador. 
4.  O Software poderá conter o software bem como outros itens de propriedade de fornecedores de terceiros, alguns dos quais poderão ser identificados num ficheiro incluso "licence.txt" ou noutro texto ou ficheiro, ou licenciados em conformidade com os mesmos. 

PROPRIEDADE DO SOFTWARE E DIREITOS AUTORAIS. .A titularidade de todas as cópias do Software permanece com a Intel ou com os seus fornecedores. O Software tem direitos de autor e está protegido pelas leis dos Estados Unidos e de outros países e pelas disposições de tratados internacionais. O utilizador não poderá remover quaisquer notificações autorais do Software. A Intel poderá, em qualquer altura e sem aviso prévio,  efectuar alterações ao Software e não ficará obrigada a suportar ou actualizar o Software. A menos que de outro modo seja expressamente especificado, a Intel não concederá qualquer direito, expresso ou implícito, nos termos de patentes, direitos de autor, marcas registadas ou outros direitos de propriedade intelectual da Intel. O utilizador poderá transferir o Software apenas e se o destinatário do mesmo acordar em ficar plenamente vinculado aos presentes termos e o utilizador não retiver quaisquer cópias do Software. 

GARANTIA DE MEIOS LIMITADA. Se o Software tiver sido entregue pela Intel em meios físicos, a Intel garante que os mesmos não contêm defeitos físicos materiais por um período de noventa dias a contar da sua entrega pela Intel. Todavia, caso seja encontrado um defeito, então tais meios deverão ser devolvidos à Intel a fim de serem substituídos ou proceder-se a uma entrega alternativa do Software, conforme seja decidido pela Intel.  

EXCLUSÃO DE OUTRAS GARANTIAS. EXCEPTO CONFORME ACIMA ESPECIFICADO, O SOFTWARE É FORNECIDO "NA FORMA COMO SE ENCONTRA" SEM QUALQUER GARANTIA EXPRESSA OU IMPLÍCITA DE QUALQUER GÉNERO, INCLUINDO GARANTIAS DE COMERCIALIZAÇÃO, NÃO VIOLAÇÃO DE PATENTES OU AJUSTAMENTO PARA UMA DETERMINADA FINALIDADE. A Intel não garante nem assume responsabilidade pela exactidão ou integralidade de qualquer informação, texto, gráficos, ligações ou outros itens contidos no Software. 

LIMITAÇÃO DE RESPONSABILIDADE. A INTEL OU OS SEUS FORNECEDORES NÃO SERÃO, EM NENHUMAS CIRCUNSTÂNCIAS, RESPONSÁVEIS POR QUAISQUER DANOS, SEJAM ELES DE QUE NATUREZA FOREM (INCLUINDO, MAS SEM A TAL SE LIMITAR, PERDA DE LUCROS, INTERRUPÇÃO DA ACTIVIDADE OU PERDA DE INFORMAÇÃO), DECORRENTES DA UTILIZAÇÃO DO SOFTWARE, OU DE INCAPACIDADE NA SUA UTILIZAÇÃO, MESMO QUANDO A INTEL TENHA SIDO INFORMADA DA POSSIBILIDADE DE OCORRÊNCIA DE TAIS DANOS. ALGUMAS JURISDIÇÕES PROÍBEM A EXCLUSÃO OU LIMITAÇÃO DE RESPONSABILIDADE POR GARANTIAS IMPLÍCITAS OU POR DANOS INDIRECTOS OU INCIDENTAIS, PELO QUE A LIMITAÇÃO ACIMA PODERÁ NÃO TER APLICAÇÃO NO CASO PRESENTE. PORÉM, O UTILIZADOR PODERÁ AINDA DISPOR DE OUTROS DIREITOS LEGAIS QUE PODEM VARIAR DE JURISDIÇÃO PARA JURISDIÇÃO. 

RESCISÃO DO CONTRATO. A Intel poderá rescindir o presente Contrato em qualquer altura no caso do utilizador violar os termos do mesmo. Mediante tal rescisão, o utilizador destruirá imediatamente o Software ou devolverá à Intel todas as cópias do Software. 

LEIS APLICÁVEIS. As reivindicações decorrentes dos termos do presente Contrato serão reguladas pelas leis de Delaware, excluindo as suas normas no respeitante a conflito de leis e a Convenção das Nações Unidas relativa a Contratos de Venda de Mercadorias. O utilizador não poderá exportar o Software em contravenção com as leis e regulamentos de exportação aplicáveis. A Intel não fica obrigada nos termos de quaisquer outros acordos, a menos que os mesmos sejam feitos por escrito e assinados por um representante autorizado da Intel. 

DIREITOS DE RESTRIÇÃO POR PARTE DO GOVERNO. O Software é fornecido com "DIREITOS RESTRITOS". A sua utilização, duplicação ou revelação por parte do Governo fica sujeita às restrições conforme estabelecidas nas normas FAR52.227-14 e DFAR252.227-7013 e seguintes ou suas sucessoras. A utilização do Software por parte do Governo constitui o reconhecimento dos direitos de propriedade da Intel no que a tal Software diz respeito. A entidade Contratante ou Fabricante é a Intel Corporation, 2200 Mission College Boulevard, Santa Clara, CA 95052. 

Os direitos específicos do utilizador podem variar de país para país. 


INTEL SOFTWARE LICENSE AGREEMENT (Final, Single User)

IMPORTANT - READ BEFORE COPYING, INSTALLING OR USING. 
Do not use or load this software and any associated materials (collectively, the "Software") until you have carefully read the following terms and conditions. By loading or using the Software, you agree to the terms of this Agreement. If you do not wish to so agree, do not install or use the Software.

LICENSE. You may copy the Software onto a single computer for your personal, noncommercial use, and you may make one back-up copy of the Software, subject to these conditions: 
1. You may not copy, modify, rent, sell, distribute or transfer any part of the Software except as provided in this Agreement, and you agree to prevent unauthorized copying of the Software.
2. You may not reverse engineer, decompile, or disassemble the Software. 
3. You may not sublicense or permit simultaneous use of the Software by more than one user.
4. The Software may contain the software and other property of third party suppliers, some of which may be identified in, and licensed in accordance with, an enclosed "license.txt" file or other text or file. 

OWNERSHIP OF SOFTWARE AND COPYRIGHTS. Title to all copies of the Software remains with Intel or its suppliers. The Software is copyrighted and protected by the laws of the United States and other countries, and international treaty provisions. You may not remove any copyright notices from the Software. Intel may make changes to the Software, or to items referenced therein, at any time without notice, but is not obligated to support or update the Software. Except as otherwise expressly provided, Intel grants no express or implied right under Intel patents, copyrights, trademarks, or other intellectual property rights. You may transfer the Software only if the recipient agrees to be fully bound by these terms and if you retain no copies of the Software.

LIMITED MEDIA WARRANTY.  If the Software has been delivered by Intel on physical media, Intel warrants the media to be free from material physical defects for a period of ninety days after delivery by Intel. If such a defect is found, return the media to Intel for replacement or alternate delivery of the Software as Intel may select.

EXCLUSION OF OTHER WARRANTIES. EXCEPT AS PROVIDED ABOVE, THE SOFTWARE IS PROVIDED "AS IS" WITHOUT ANY EXPRESS OR IMPLIED WARRANTY OF ANY KIND INCLUDING WARRANTIES OF MERCHANTABILITY, NONINFRINGEMENT, OR FITNESS FOR A PARTICULAR PURPOSE.  Intel does not warrant or assume responsibility for the accuracy or completeness of any information, text, graphics, links or other items contained within the Software.

LIMITATION OF LIABILITY. IN NO EVENT SHALL INTEL OR ITS SUPPLIERS BE LIABLE FOR ANY DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, LOST PROFITS, BUSINESS INTERRUPTION, OR LOST INFORMATION) ARISING OUT OF THE USE OF OR INABILITY TO USE THE SOFTWARE, EVEN IF INTEL HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS PROHIBIT EXCLUSION OR LIMITATION OF LIABILITY FOR IMPLIED WARRANTIES OR CONSEQUENTIAL OR INCIDENTAL DAMAGES, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU. YOU MAY ALSO HAVE OTHER LEGAL RIGHTS THAT VARY FROM JURISDICTION TO JURISDICTION. 

TERMINATION OF THIS AGREEMENT. Intel may terminate this Agreement at any time if you violate its terms. Upon termination, you will immediately destroy the Software or return all copies of the Software to Intel.
 
APPLICABLE LAWS. Claims arising under this Agreement shall be governed by the laws of Delaware, excluding its principles of conflict of laws and the United Nations Convention on Contracts for the Sale of Goods. You may not export the Software in violation of applicable export laws and regulations. Intel is not obligated under any other agreements unless they are in writing and signed by an authorized representative of Intel.

GOVERNMENT RESTRICTED RIGHTS. The Software is provided with "RESTRICTED RIGHTS." Use, duplication, or disclosure by the Government is subject to restrictions as set forth in FAR52.227-14 and DFAR252.227-7013 et seq. or its successor. Use of the Software by the Government constitutes acknowledgment of Intel's proprietary rights therein. Contractor or Manufacturer is Intel Corporation, 2200 Mission College Blvd., Santa Clara, CA 95052.
