PRIMA DI SCARICARE IL SOFTWARE DA INTERNET È NECESSARIO ACCETTARE I TERMINI DEL PRESENTE CONTRATTO FACENDO CLIC SU "I AGREE" (ACCETTO). Il presente documento costituisce contratto legale tra l'utente e Creative Technology Ltd. e le sue consociate e affiliate ("Creative"). Il presente Contratto descrive i termini e le condizioni in base ai quali Creative concede in licenza i programmi software scaricati da questo sito Web e la relativa documentazione e materiali accessori, ivi inclusi, a titolo esemplificativo e non esaustivo, i file eseguibili, i driver, le librerie e i file di dati associati a tali programmi (denominati collettivamente "Software"). LICENZA 1. Concessione di licenza. Il Software viene concesso in licenza, e non venduto, esclusivamente per l'uso in conformità ai termini del presente Contratto. Il Contratto di licenza costituisce prova dell'autorizzazione ad esercitare i diritti da esso conferiti e deve essere pertanto conservato dall'utente. Tra l'utente e Creative (e, nella misura applicabile, i suoi concessori di licenza), Creative ritiene tutti i titoli e la proprietà del Software si riserva tutti i diritti non espressamente concessi. Creative concede all'utente il diritto a utilizzare il Software completamente o parzialmente a condizione che (a) il Software non sia distribuito a fini di lucro; (b) il Software sia utilizzato solo unitamente a prodotti Creative; (c) il Software NON sia modificato; (d) tutti gli avvisi di copyright presenti nel Software siano mantenuti; (e) il licenziatario o utente finale riconosca di essere soggetto ai termini di questo Contratto. 2. Uso autorizzato su un solo computer. Il Software può essere utilizzato su un solo computer e da un solo utente nello stesso momento. L'utente è autorizzato a trasferire da un computer a un altro la porzione del Software leggibile dall'elaboratore a condizione che (a) il Software (inclusa ogni sua parte o copia) sia eliminato dal primo computer e (b) non vi sia alcuna possibilità che il Software sia utilizzato su più di un computer allo stesso tempo. 3. Uso non in rete. L'utente è autorizzato a utilizzare il Software solo su un computer non in rete, ovvero in modo tale che il Software e le sue funzioni siano accessibili solo a persone che si trovino fisicamente di fronte al computer sul quale il Software è installato. L'utente non può consentire l'accesso remoto al Software o alle sue funzioni, né può trasmettere il Software o parti di esso attraverso una rete o una linea di comunicazione. 4. Copyright. Il Software è proprietà di Creative e/o dei suoi concessori di licenza ed è protetto dalle leggi degli Stati Uniti e dai trattati internazionali sul copyright. È proibito rimuovere l'avviso di copyright dalle copie del Software o della eventuale documentazione stampata acclusa al Software. 5. Copia di backup. L'utente è autorizzato a effettuare una (1) copia di archivio della porzione di Software leggibile dall'elaboratore al solo fine di backup in supporto all'utilizzo del Software su un computer singolo, purché vengano riprodotti tutti gli avvisi di copyright e altre eventuali dichiarazioni di proprietà presenti sulla copia originale del Software. 6. Inclusione o integrazione. Non è consentito includere alcuna porzione del Software in un altro programma, né integrare alcuna porzione del Software con un altro programma, salvo che nella misura espressamente consentita dalle leggi in vigore nel luogo in cui si utilizza il Software. In questo caso, la porzione del Software eventualmente inclusa o integrata con un altro programma sarà comunque soggetta ai termini e alle condizioni di questo contratto, e l'utente è tenuto a riprodurre sulla parte inclusa o integrata tutti gli avvisi di copyright e altre eventuali dichiarazioni di proprietà presenti sulla copia originale del Software. 7. Versione per reti. Se è stata acquistata una "versione per reti" del Software, il presente Contratto si applica all'installazione del Software su un singolo "server di file." Il Software non può essere copiato su più sistemi. Ogni "nodo" connesso al "server di file" deve disporre di un'apposita licenza per "copia di nodo" del Software, valida esclusivamente per quel "nodo". 8. Trasferimento di licenza. L'utente non è autorizzato a trasferire a terzi la propria licenza. 9. Restrizioni di utilizzo, copia e modifica del Software. L'utente non può utilizzare, copiare o modificare il Software in modo o in misura diversi da quanto espressamente consentito dal presente Contratto e dalle leggi in vigore nel paese in cui è stato acquistato il Software. In base a questo Contratto, l'utente non è autorizzato a concedere in sublicenza alcuno dei propri diritti. L'utente può utilizzare il Software per scopi esclusivamente personali e non per proiezioni o spettacoli pubblici, né per la realizzazione di videocassette destinate alla riproduzione in pubblico. 10. Decompilazione, disassemblaggio o decodifica del software. L'utente riconosce che il Software contiene segreti industriali e altre informazioni proprietarie di Creative e dei suoi concessori di licenza. Pertanto non può decompilare, dissassemblare o decodificare il Software se non nei modi e nella misura espressamente consentiti dal presente Contratto e dalle leggi in vigore nel paese in cui è stato acquistato il Software. In particolare l'utente accetta di non trasmettere il Software per alcun motivo e di non visualizzarne il codice su uno schermo di computer né effettuare stampe di estratti di memoria del codice del Software. Se necessita di informazioni sulla interoperabilità del Software con altri programmi, l'utente non decompilerà o disassemblerà il Software per ottenere tali informazioni, ma si rivolgerà a Creative a uno degli indirizzi riportati più oltre. Creative valuterà quindi se l'utente necessita di tali informazioni per una ragione legittima e in caso positivo fornirà tali informazioni in tempi e modalità ragionevoli. In ogni caso, l'utente è tenuto a notificare a Creative l'eventuale acquisizione di informazioni mediante decodifica del Software o simili sistemi; tali informazioni saranno considerate confidenziali e potranno essere utilizzate solo in connessione con il Software. 11. Software con funzionalità CDDB. Questo pacchetto include applicazioni che possono contenere software di CDDB, Inc. di Berkeley, California ("CDDB"). Il software CDDB ("client CDDB") consente l'identificazione online del disco e il recupero dei relativi dati musicali, come titolo, nome dell'artista e traccia ("dati CDDB") dai server online ("server CDDB"), nonché l'esecuzione di altre funzioni. L'utente si impegna a utilizzare i dati CDDB, il client CDDB e i server CDDB solo per scopi personali e non per uso commerciale. Si impegna altresì a non assegnare, copiare, trasferire o trasmettere a terzi il client o i dati CDDB. L'UTENTE SI IMPEGNA A NON UTILIZZARE O SFRUTTARE I DATI, IL CLIENT O I SERVER CDDB IN MODO DIVERSO DA QUANTO ESPRESSAMENTE CONSENTITO IN QUESTO CONTRATTO. L'utente accetta che l'eventuale violazione di queste restrizioni invaliderebbe la sua licenza non esclusiva a utilizzare i dati CDDB, il client CDDB e i server CDDB. Qualora la licenza fosse invalidata, l'utente si impegna a cessare qualsiasi impiego dei dati, del client e del server CDDB. CDDB si riserva tutti i diritti sui dati CDDB, sul client CDDB e sui server CDDB, inclusi tutti i diritti di proprietà. L'utente accetta che CDDB, Inc. agisca direttamente nei confronti dell'utente per far valere i diritti che le sono conferiti da questo contratto. Il client CDDB e ogni parte dei dati CDDB sono concessi in licenza "COSÌ COME SONO." CDDB non offre alcuna garanzia, espressa o implicita, sull'accuratezza dei dati CDDB provenienti dai server CDDB. CDDB si riserva il diritto di eliminare i dati dai server CDDB e di modificare le categorie di dati per qualsiasi motivo che, a suo giudizio, ritenga sufficiente. Non viene in alcun modo garantito che il client o i server CDDB siano privi di errori e che il loro funzionamento non subisca interruzioni. CDDB non è tenuta a fornire all'utente eventuali tipi di dati o categorie migliorati o aggiuntivi che decida di introdurre in futuro. CDDB NON RILASCIA ALCUN TIPO DI GARANZIA ESPLICITA O IMPLICITA, INCLUSE, IN VIA ESEMPLIFICATIVA, LE GARANZIE IMPLICITE DI COMMERCIABILITÀ, IDONEITÀ AD USO PARTICOLARE, PROPRIETÀ E DI NON VIOLAZIONE DEI DIRITTI ALTRUI. CDDB non garantisce i risultati ottenuti dall'uso del client o dei server CDDB. IN NESSUNA CIRCOSTANZA CDDB POTRÀ ESSERE RITENUTA RESPONSABILE PER DANNI CONSEGUENZIALI O INCIDENTALI O PER MANCATI GUADAGNI E PROFITTI. RISOLUZIONE DEL CONTRATTO Il presente Contratto ha effetto fino alla sua risoluzione. L'utente può risolvere il Contratto in qualsiasi momento distruggendo il Software e tutte le porzioni o copie in suo possesso o controllo. Il Contratto si considera inoltre automaticamente risolto, senza notifica da parte di Creative, se l'utente viola uno qualsiasi dei termini e condizioni. In tali circostanze, l'utente si impegna a distruggere il Software e tutte le porzioni o copie. In caso di risoluzione del Contratto, Creative può inoltre esercitare alcuni o tutti i diritti di legge. Le clausole che proteggono i diritti proprietari di Creative continuano a valere anche dopo la risoluzione del Contratto. ESCLUSIONE DI GARANZIA L'UTENTE UTILIZZA IL SOFTWARE A SUO RISCHIO. IL SOFTWARE È DESTINATO ALL'UTILIZZO ESCLUSIVO CON L'HARDWARE CREATIVE E RELATIVO SOFTWARE E VIENE FORNITO "COSÌ COME È" SENZA GARANZIE DI ALCUN TIPO. NELLA MISURA MASSIMA CONSENTITA DALLA LEGGE, CREATIVE NEGA QUALSIASI GARANZIA, ESPRESSA O IMPLICITA, COMPRESE, SENZA ECCEZIONI, TUTTE LE GARANZIE IMPLICITE E DI COMMERCIABILITÀ E DI IDONEITÀ PER UN FINE PARTICOLARE. CREATIVE NON È TENUTA A FORNIRE AGGIORNAMENTI DEL SOFTWARE. Nessun distributore, rappresentante o altra persona è autorizzato ad ampliare o modificare questa garanzia o altre clausole del Contratto. Creative non garantisce che le funzioni del Software soddisfino i requisiti dell'utente o che il funzionamento del Software sia ininterrotto o esente da errori e da codice nocivo. In questo contesto si intende per "codice nocivo" ogni tipo di codice concepito al fine di danneggiare altri programmi o dati di computer, consumare le risorse del computer, modificare, distruggere, registrare o trasmettere dati, o interferire in altro modo con il normale funzionamento del computer, dei sistemi e delle reti, come virus, cavalli di Troia, dropper, vermi, bombe logiche e simili. Fatte salve le garanzie espressamente fornite con il presente Contratto, nessuna asserzione sarà vincolante per Creative. L'utente si assume la responsabilità della scelta del Software per raggiungere i risultati desiderati nonché del download, dell'utilizzo del Software e dei risultati conseguenti. L'utente si assume tutti i rischi derivanti dalla qualità e dalle prestazioni del Software. Qualora il Software fosse difettoso, l'utente, e non Creative o i suoi distributori, si farà carico di tutti i costi necessari per la riparazione del difetto. La presente garanzia conferisce all'utente diritti legali specifici; oltre a questi, l'utente può inoltre essere titolare di altri diritti che variano in base alla giurisdizione locale. Poiché alcuni Stati non ammettono l'esclusione delle garanzie implicite, alcune delle suddette esclusioni potrebbero non applicarsi al caso specifico. Creative non riconosce alcuna garanzia nel caso in cui il Software sia stato personalizzato, riconfezionato o modificato in alcun modo da terzi. ESCLUSIONE DI RESPONSABILITÀ PER DANNI DIRETTI O INDIRETTI CREATIVE O I SUOI CONCESSORI DI LICENZA NON POTRANNO ESSERE RITENUTI RESPONSABILI PER DANNI DI ALCUN TIPO, COMPRESI, SENZA ECCEZIONI, I DANNI CONSEGUENZIALI, SPECIALI, INCIDENTALI, INDIRETTI, DIRETTI O ESEMPLARI, I DANNI PER MANCATO GUADAGNO, INTERRUZIONE DELL'ATTIVITÀ, PERDITA DI INFORMAZIONI COMMERCIALI O ALTRE PERDITE PECUNIARIE DERIVANTI DALL'USO O DALL'IMPOSSIBILITÀ DELL'USO DI QUESTO SOFTWARE, ANCHE QUALORA CREATIVE O I SUOI CONCESSORI DI LICENZA SIANO A CONOSCENZA DELLA POSSIBILITÀ DI TALI DANNI. Poiché alcuni Stati o giurisdizioni non ammettono l'esclusione o la limitazione di responsabilità per danni diretti o indiretti, la limitazione di cui sopra potrebbe non essere applicabile all'utente. INDENNIZZO DA PARTE DELL'UTENTE Qualora l'utente distribuisca il Software in violazione di questo Contratto, si impegna a indennizzare, manlevare e difendere Creative da ogni e qualsiasi istanza, ricorso o procedimento legale, facendosi altresì carico di tutte le spese legali, che derivino o siano connessi all'utilizzo o alla distribuzione del Software in violazione del presente Contratto. Inoltre, Creative non è responsabile dell'accuratezza delle informazioni fornite dal personale di assistenza tecnica di Creative o di terzi, né dei danni derivanti, sia direttamente che indirettamente, da azioni o negligenze dell'utente conseguenti al servizio di assistenza. LIMITAZIONI DEI DIRITTI DEL GOVERNO DEGLI STATI UNITI Il Software e la relativa documentazione sono soggetti a limitazione dei diritti. L'utilizzo, la duplicazione e la divulgazione da parte del Governo degli Stati Uniti sono soggetti alle restrizioni di cui alla clausola 252.227-7013, (b)(3)(ii) di "Rights in Technical Data and Computer Software". Qualora il Software sia concesso in sublicenza o utilizzato fuori dagli Stati Uniti, l'utente sarà tenuto a rispettare le leggi locali, le leggi degli Stati Uniti sul controllo delle esportazioni e la versione inglese del presente Contratto. FORNITORE/PRODUTTORE Il fornitore/produttore del Software è: Creative Technology Ltd 31, International Business Park Creative Resource Singapore 609921 CLAUSOLE GENERALI Il presente Contratto è vincolante per l'utente e per i suoi eventuali dipendenti, datori di lavoro, fornitori e rappresentanti, nonché successori e cessionari. Nè il Software nè i dati da esso derivanti possono essere esportati, se non in conformità alle leggi degli Stati Uniti o ad altre disposizioni applicabili. Il presente accordo è governato dalle leggi della California, ad eccezione degli ambiti di competenza delle leggi federali sul copyright e sui marchi registrati. Il presente Contratto costituisce l'unico accordo valido fra Creative e l'utente. Quest'ultimo non riterrà Creative responsabile per eventuali asserzioni o dichiarazioni non veritiere fatte dall'azienda stessa, dai suoi rappresentanti o da chiunque altro, sia in buona fede che con negligenza, in base alle quali l'utente abbia deciso di stipulare questo Contratto, a meno che tali asserzioni o dichiarazioni siano state fatte a scopo fraudolento. Questo contratto sostituisce ogni altro accordo o intesa precedente, compreso, tra l'altro, il contenuto della pubblicità relativa al Software. Qualora una clausola del presente Contratto fosse ritenuta contraria alle norme di legge da un Foro competente, tale clausola verrà interpretata e modificata in modo da garantirne la validità e l'applicabilità, mentre le restanti clausole rimarranno valide ed effettive. Per questioni relative al prodotto o di natura tecnica, contattare il centro di assistenza tecnica Creative più vicino. DISPOSIZIONI SPECIALI APPLICABILI ALL'INTERNO DELL'UNIONE EUROPEA ==================================================================== Se il Software è stato scaricato in un paese dell'Unione Europea (UE), si applicano le disposizioni descritte di seguito. In caso di incongruenza fra i termini del Contratto di licenza del Software delineati sopra e le seguenti disposizioni, prevalgono queste ultime. Creative valuterà quindi se l'utente necessita di tali informazioni per una ragione legittima e in caso positivo fornirà tali informazioni in tempi e modalità ragionevoli. Garanzia limitata SALVO QUANTO ESPOSTO SOPRA E NEI TERMINI STABILITI ALLA VOCE "DIRITTI LEGALI", IL SOFTWARE È FORNITO COSÌ COM'È SENZA GARANZIA ALCUNA, ESPRESSA O IMPLICITA, COMPRESE, IN VIA ESEMPLIFICATIVA, TUTTE LE GARANZIE IMPLICITE E DI COMMERCIABILITÀ, QUALITÀ E IDONEITÀ AD UN FINE PARTICOLARE. Limitazione dei rimedi e dei risarcimenti LA LIMITAZIONI AI RIMEDI E AI RISARCIMENTI STABILITE DAL CONTRATTO DI LICENZA DEL SOFTWARE NON SI APPLICANO AI DANNI ALLE PERSONE (INCLUSO IL DECESSO) CAUSATI DA NEGLIGENZA DA PARTE DI CREATIVE E SONO SOGGETTI AI TERMINI DESCRITTI ALLA VOCE "DIRITTI LEGALI". Diritti legali Le leggi irlandesi prevedono che, nei contratti relativi alla vendita di beni o alla fornitura di servizi, alcune condizioni e garanzie siano implicite. Per quanto riguarda questa transazione, tali condizioni e garanzie sono escluse nella misura consentita dalle leggi irlandesi. Di contro, le condizioni e le garanzie che non possono essere escluse senza violare le leggi irlandesi sono in vigore. Pertanto nessuna disposizione contenuta nel presente Contratto pregiudicherà eventuali diritti conferiti all'utente dalle sezioni 12, 13, 14 o 15 dell'Irish Sale of Goods Act 1893 (e successivi emendamenti). Condizioni generali Il presente Contratto è governato dalle leggi della Repubblica di Irlanda. Per il Software scaricato in un paese dell'Unione Europea (UE) è valida la versione del Contratto nella lingua locale. Il presente Contratto costituisce l'unico accordo valido fra Creative e l'utente. Quest'ultimo non riterrà Creative responsabile per eventuali asserzioni o dichiarazioni non veritiere fatte dall'azienda stessa, dai suoi rappresentanti o da chiunque altro, sia in buona fede che con negligenza, in base alle quali l'utente abbia deciso di stipulare questo Contratto, a meno che tali asserzioni o dichiarazioni siano state fatte a scopo fraudolento. INFORMAZIONI SUL COPYRIGHT PER GLI UTENTI DEI PRODOTTI CREATIVE ==================================================================== Alcuni prodotti Creative sono concepiti allo scopo di agevolare la riproduzione di materiali per i quali l'utente dispone di copyright o di autorizzazione alla copia da parte del proprietario del copyright, o di materiali esenti da copyright in base alle leggi vigenti. L'utente che non dispone del copyright o di autorizzazione del proprietario del copyright potrebbe infrangere le leggi sul copyright ed essere passibile di risarcimento danni o di altri rimedi. In caso di dubbio circa i propri diritti, si consiglia di rivolgersi al proprio consulente legale. È responsabilità dell'utente assicurarsi di non violare le leggi vigenti sul copyright quando utilizza un prodotto Creative, nei casi in cui la copia di determinato materiale potrebbe richiedere il previo consenso del proprietario del copyright. Creative declina qualsiasi responsabilità relativa all'uso illegale suoi prodotti e in nessun caso potrà essere ritenuta responsabile dell'origine dei dati memorizzati in file audio digitali compressi. L'utente riconosce e accetta che l'uso di MP3 Codecs per la trasmissione in tempo reale (terrestre, satellitare, via cavo o con altri dispositivi) o per la trasmissione tramite Internet o su altre reti, come, tra l'altro, intranet e così via, o in applicazioni audio a pagamento, non è autorizzata e/o concessa in licenza (http://www.iis.fhg.de/amm/). ==================================================================== F i n e d e l C o n t r a t t o ==================================================================== ==================================================================== CREATIVE END-USER SOFTWARE LICENSE AGREEMENT (for Web Software) Version 2.5, July 2001 ==================================================================== PLEASE READ THIS DOCUMENT CAREFULLY. BEFORE DOWNLOADING THE SOFTWARE FROM THE INTERNET YOU MUST AGREE TO THE TERMS OF THIS AGREEMENT BY CLICKING "I AGREE". This is a legal agreement between you and Creative Technology Ltd. and its subsidiaries ("Creative"). This Agreement states the terms and conditions upon which Creative offers to license the software downloaded from this website together with all related documentation and accompanying items including, but not limited to, the executable programs, drivers, libraries and data files associated with such programs (collectively, the "Software"). LICENSE 1. Grant of License. The Software is licensed, not sold, to you for use only under the terms of this Agreement. This License Agreement is your proof of license to exercise the rights granted herein and must be retained by you. As between you and Creative (and, to the extent applicable, its licensors), Creative retains all title to and ownership of the Software and reserves all rights not expressly granted to you. Creative grants to you the right to use all or a portion of this Software provided that (a) the Software is not distributed for profit; (b) the Software is used only in conjunction with Creative's family of products; (c) the Software may NOT be modified; (d) all copyright notices are maintained on the Software; and (e) the licensee/end-user agrees to be bound by the terms of this Agreement. 2. For Use on a Single Computer. The Software may be used only on a single computer by a single user at any time. You may transfer the machine-readable portion of the Software from one computer to another computer, provided that (a) the Software (including any portion or copy thereof) is erased from the first computer, and (b) there is no possibility that the Software will be used on more than one computer at a time. 3. Stand-Alone Basis. You may use the Software only on a stand-alone basis, such that the Software and the functions it provides are accessible only to persons who are physically present at the location of the computer on which the Software is loaded. You may not allow the Software or its functions to be accessed remotely, or transmit all or any portion of the Software through any network or communication line. 4. Copyright. The Software is owned by Creative and/or its licensees, and is protected by United States copyright laws and international treaty provisions. You may not remove the copyright notice from any copy of the Software or any copy of the written materials, if any, accompanying the Software. 5. One Archival Copy. You may make one (1) archival copy of the machine-readable portion of the Software for backup purposes only in support of your use of the Software on a single computer, provided that you reproduce on the copy all copyright and other proprietary rights notices included on the originals of the Software. 6. No Merger or Integration. You may not merge any portion of the Software into, or integrate any portion of the Software with, any other program, except to the extent expressly permitted by the laws of the jurisdiction where you are located. Any portion of the Software merged into or integrated with another program, if any, will continue to be subject to the terms and conditions of this Agreement, and you must reproduce on the merged or integrated portion all copyright and other proprietary rights notices included on the originals of the Software. 7. Network Version. If you have purchased a "network" version of the Software, this Agreement applies to the installation of the Software on a single "file server." It may not be copied onto multiple systems. Each "node" connected to the "file server" must also have its own license of a "node copy" of the Software, which becomes a license only for that specific "node." 8. Transfer of License. You may not transfer your license of the Software to a third party. 9. Limitations on Using, Copying, and Modifying the Software. Except to the extent expressly permitted by this Agreement or by the laws of the jurisdiction where you acquired the Software, you may not use, copy or modify the Software. Nor may you sub-license any of your rights under this Agreement. You may use the Software for your personal use only, and not for public performance or for the creation of publicly displayed videotapes. 10. Decompiling, Disassembling, or Reverse Engineering. You acknowledge that the Software contains trade secrets and other proprietary information of Creative and its licensors. Except to the extent expressly permitted by this Agreement or by the laws of the jurisdiction where you are located, you may not decompile, disassemble or otherwise reverse engineer the Software, or engage in any other activities to obtain underlying information that is not visible to the user in connection with normal use of the Software. In particular, you agree not for any purpose to transmit the Software or display the Software's object code on any computer screen or to make any hardcopy memory dumps of the Software's object code. For Software With CDDB Features. This package includes applications which may contain software from CDDB, Inc.of Berkeley California ("CDDB"). The software from CDDB (the "CDDB Client") enables the application to do online disc identification and obtain music-related information, including name, artist, track and title information ("CDDB Data") from online servers ("CDDB Servers") and to perform other functions. You agree that you will use CDDB Data, the CDDB Client and CDDB Servers for your own personal non-commercial use only. You agree not to assign, copy, transfer or transmit the CDDB Client or any CDDB Data to any third party. YOU AGREE NOT TO USE OR EXPLOIT CDDB DATA, THE CDDB CLIENT,OR CDDB SERVERS,EXCEPT AS EXPRESSLY PERMITTED HEREIN. You agree that your non-exclusive license to use the CDDB Data, the CDDB Client and CDDB Servers will terminate if you violate these restrictions. Any representation, other than the warranties set forth in this Agreement, will not bind Creative. You assume full responsibility for the selection of the Software to achieve your intended results, and for the downloading, use and results obtained from the Software. You also assume the entire risk as it applies to the quality and performance of the Software. Should the Software prove defective, you (and not Creative, or its distributors or dealers) assume the entire cost of all necessary servicing, repair or correction. This warranty gives you specific legal rights, and you may also have other rights which vary from country/state to country/state. Some countries/states do not allow the exclusion of implied warranties, so the above exclusion may not apply to you. Creative disclaims all warranties of any kind if the Software was customized, repackaged or altered in any way by any third party other than Creative. Further, Creative shall not be liable for the accuracy of any information provided by Creative or third-party technical support personnel, or any damages caused, either directly or indirectly, by acts taken or omissions made by you as a result of such technical support. U.S. GOVERNMENT RESTRICTED RIGHTS All Software and related documentation are provided with restricted rights. Use, duplication or disclosure by the U.S. Government is subject to restrictions as set forth in subdivision (b)(3)(ii) of the Rights in Technical Data and Computer Software Clause at 252.227-7013. After your driver has been downloaded, follow these simple steps to install it.
Expand the archive file (if the download file is in zip or rar format).
If the expanded file has an .exe extension, double click it and follow the installation instructions.
Otherwise, open Device Manager by right-clicking the Start menu and selecting Device Manager.
Find the device and model you want to update in the device list.
Double-click on it to open the Properties dialog box.
From the Properties dialog box, select the Driver tab.
Click the Update Driver button, then follow the instructions.
Very important: You must reboot your system to ensure that any driver updates have taken effect.
