THE IOMEGA LIMITED WARRANTY Iomega warrants this hardware product and the hardware aspects of its related storage media to be free from defects in material and workmanship. THIS WARRANTY SHALL NOT APPLY TO AND IOMEGA MAKES NO WARRANTY WITH RESPECT TO: (A) ANY SOFTWARE PRODUCTS OR ANY SOFTWARE ASPECTS OF STORAGE MEDIA SUPPLIED BY IOMEGA: (B) EXPENDABLE COMPONENTS SUCH AS, BUT NOT LIMITED TO, FUSES, BULBS, AND CLEANING ACCESSORIES SUCH AS PADS AND FILTERS: (C) PRODUCTS NOT MANUFACTURED BY OR FOR IOMEGA: AND (D) ANY EXPERIMENTAL OR DEVELOPMENT PRODUCTS -- ALL OF WHICH ARE PROVIDED "AS-IS." Iomega's warranty shall not be enlarged, diminished, or affected by, and no liability shall arise out of, Iomega's rendering of technical advice or providing information to the original end user purchaser ("Purchaser"). This warranty is not transferable by Purchaser. If Purchaser finds a defect in an Iomega product, Purchaser must notify Iomega within the warranty period. Purchaser may call Iomega at 1-888-4-IOMEGA (446-6342) to receive information about obtaining warranty service. This number is the same as is used for Iomega's fee-based technical support. For Jaz, Ditto and Buz products, this warranty entitles Purchaser to free technical support for 30 days from Purchaser's first call during the warranty period. After that time Purchaser will be charged to consult with Iomega technical support. For Zip products, Purchaser will be charged to consult with Iomega technical support. Purchaser will not incur any technical support charge if the Iomega product is found to be defective and is covered by this warranty. The current charge is $19.99 per incident for Jaz products and $14.99 per incident for Zip. Ditto and Buz products, Iomega reserves the right to amend these charges without prior notice. Iomega's warranty periods are: one-year limited warranty for Zip drives, Jaz drives, Jaz Jet, and Jaz Traveller; two-year limited warranty for Ditto drives and Iomega and Ditto tape cartridges; five-year limited warranty for 230MB products and Gold Standards disk for Bernoulli; and limited lifetime warranty for as long as Purchaser owns the relevant product for Zip disks and Jaz media. In each of the foregoing cases, the warranty period begins on the original purchase date by Purchaser. Iomega's warranty excludes warranty claims made after the expiration of the foregoing warranty periods. Iomega shall, at its option and cost, repair or replace the defect product or part if the product is returned by Purchaser, together with Purchaser's name, address, telephone number, a description of the problem and dated proof of purchase, to Iomega or to an Iomega authorized service facility, transportation and insurance prepaid, within the applicable warranty period and if the product is found to be defective within the terms of the warranty. If Iomega is unable to repair or exchange such a defective product or part, then Purchaser's exclusive remedy and Iomega's entire liability in contract tort, or otherwise is the payment by Iomega to Purchaser of an amount not to exceed the amount originally paid by Purchaser for the irreparable product. Before presenting any product for warranty service, Purchaser must remove any removable storage media and all programs, data files, and other data from any storage media. Iomega undertakes no responsibility or obligation to return to Purchaser any programs, data files, or other data stored on media that is returned to Iomega. Replacement products and parts used to repair products may be similar new items or other than new. Products and parts that have been replaced shall become the property of Iomega. If any product returned by Purchaser to Iomega for repair or replacement is not defective within this warranty, Iomega shall so advise Purchaser and thereafter Iomega shall dispose of such product in accordance with Purchaser's instructions and at Purchaser's cost, after reimbursement to Iomega by Purchaser of examination and testing expenses at Iomega's then current rates. The warranty shall not apply to any failure or defect caused by misuse (including but not limited to using unauthorized third party media or software), abnormal or unusually heavy use, neglect, abuse, alteration, improper installation, unauthorized repair or modification, improper testing, accident or causes external to the product such as but not limited to excessive heat or humidity, power failure or surges, or improper installation. In the case of Zip disks and Jaz storage media, this warranty shall not apply to any failure or defects resulting from normal wear. Purchaser's sole remedy under this warranty shall be, at Iomega's sole election, repair or replacement of the defective product or part (or in certain circumstances noted above, refund of the purchase price of the product), all as provided in this warranty. Iomega's sole and exclusive maximum liability for any claim by Purchaser or anyone claiming through or on behalf of Purchaser arising out of Purchaser's purchase or use of a product and/or the above warranty shall not in any event exceed the actual amount paid by Purchaser for the product. In no event shall Iomega be liable for any indirect, incidental, collateral, exemplary, punitive, consequential or special damages or losses arising out of Purchaser's purchase of products and/or out of this warranty, including without limitation, loss of use, profits, goodwill or savings or loss of data, data files, or programs that may have been stored by a user of the product even if Iomega has been advised of the possibility of such damages or claims. Some states do not allow the exclusive or limitation of incidental, punitive, or consequential damages, so the above limitation or exclusion may not apply to Purchaser. Where applicable, if Purchaser qualifies as a "consumer" under the Magnuson-Moss Warranty Act, then Purchaser shall be entitled to any implied warranties allowed by law for the period of the express warranty as set forth above. Some states do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to Purchaser, EXCEPT AS STATED ABOVE IN THE PARAGRAPH, THE FOREGOING WARRANTIES ARE IN LIEU OF ALL OTHER CONDITIONS OR WARRANTIES, EXPRESS, IMPLIED OR STATUTORY, INCLUDING WITHOUT LIMITATION, AN IMPLIED CONDITION OR WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE AND OF ANY OTHER WARRANTY OBLIGATION ON THE PART OF IOMEGA. IOMEGA DOES NOT ASSUME OR AUTHORIZE ASSUMPTION OF LIABILITY FOR IT OR ANY OTHER WARRANTY, EITHER EXPRESS OR IMPLIED. This warranty gives U.S. Purchasers specific legal rights and Purchasers may also have other rights that vary from State to State.
